Is the birth certificate required for dependants too or just the principal applicant...Can someone please clarify.....My PD is not current (EB-3 India Nov 2003)..But hoping it will be current in a few months....So just want to keep all docs ready if the dates are current.....

My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.
These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.
Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.
Thank you Totoro. People like you keeps the hope alive in our heart that someday justice will be done.
So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
Firstly, How fair will that be for our children who are Legit Citizens of US.
These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).
BTW, my moral support has always with Obama, and with Zoe Loefgren.
Many of us cried when Obama read his oath. That was the defining moment for all people who have been subjected to injustice, been told that they were not good enough because of their race or country of origin. Think about it... The Chinese and Indians having to wait so many years just to get a GC is injustice being done to a people of certain origin. Oh well!

It is very clear that USCIS is yet to complete the receipt of all I-485 applications and are not in a position to give any statistics to DOL. I think then they will be busy in issuing AP / EAD based on the receipt. Considering the current work load, I think it will take at least couple of months for the USCIS to give any reasonable estimate to DOL regarding the actual demand. Till that time, I think DOL will be forced to publish the same status every month. :(
I wish USCIS can use the people worked in Backlog Elimination centers to issue EAD / AP and clear I-485 receipts and provide some meaningful figures to DOL. [I hope they do not create another July bulletin fiasco :D]

I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.
Until we get an amendment to CSPA I feel there will be so many more cases of hardship and termoil to come to notice

Does anybody know any link that gives online status of PERM labor ? I heard that there is one for employers but not for employee.
No you cannot do this, just the Employer and Lawyer can do this. My Employer gives me the login password, perhaps you can ask the Employer to make for you a sub-account, or to give you the Login Dates.

I want to add 'Family and Relatives pressure' in addition to 'Peer Pressure'. When I visited India lasttime, I was asked by almost all the relatives if We had bought a house. It has become an indication if we are doing well (earning well). After a while, i felt little bit uneasy to say that we did not buy house while many of our cousins already did. thats family pressure.
Other than for monetary reasons, there is a small group of people, who do not buy house even if they can afford to and live in apartments
- still not decided where to settle down,
- want to move to warm place, but just not yet due to job,
- think it is lonely to live in a big house with unfamiliar neighbors.
- have small kids, takes lot of time to meet their needs after work, daycare. cannot take the burden of maintaining a big house.

I have some questions with regards to my wife�s immigration status. She was previously on H-4 visa (valid till 2009) when I was with employer A. She then applied for an H-1 which started from October, 2007. She started working on a project from November. The project lasted for couple of months. During that time, I transferred my H1 to employer B. Since January, her company has no projects for her and she is not working. But they had been asking her to sign leave of absence and providing partial pay stubs (one week in a month) since then. Now she wants to transfer back to H-4 status and we are planning to file for a change of status from H-1 to H-4. My questions are:
1) Are pay stubs of current H-1 employment required while filing for change of status to H-4?
If yes, will it be OK if she just provide a partial month pay stub for last two months and rest of the days, we can show it as absence of leave due to some reasons? This is to avoid large amount of taxes which we have to pay in order to get the pay stubs. The employer is ready to provide other papers required to prove current employment with them. (Like offer letter and other stuff)
2) Can she go back to India without change of status and stamp her previous H-4 and come back to US on H-4? The problem I feel with this situation is that her H-4 was approved when I was working with employer A but currently I am working for employer B. So does that mean that she has to apply for a completely new H-4?
3) Can we go to any other country like Canada, Mexico, and Bahamas and get a new H-4 stamped for her? Or it has to be done from India? I will also get my H-1 stamped the same time.
4) What are the documents that will be required to file for COS using form I-539 and how long it usually takes to get approved?
5) Can she travel to India while her COS is still under process?

My PD, Sep 2005, is current as well and has been current since since last month but no magic emails yet. By the way, when I called the CIS today, the officer indicated that my finger print is cleared but name check is still pending. I thought they were the same? Does anyone know what the difference is between the two?

I got the CPO email just now.. i'm not sure if it's because of the SR that my wife opened on Friday evening or it just happened without that.. but anyways it's a relief now.. i also see a lot of people getting cpo emails today.. btw, just curious, does the cpo stage come before "approved" status or after it?
now hope that i receive the card in time.. will post about its validity and start date once i receive it. (i'll be current for the month of September as my pd is july 06)

Grass-roots advocacy means advocacy at ground level.
Ground level in political terms means opinion of actual worker who is doing the work and in this case it would be all the people who are actually doing the work of meeting meeting law makers and to explain retrogresssion to them. That would be the donors and people like you who have our respect. For a grass root level advocacy to work an organization has to be made up of grass root worker. Grass root workers are the people at the bottom of totem pole. In our case that would be EB3 workers now we all know that EB2 workers when they get their green card dissapear from the forum and leaves the EB3 guys to carry the burden (case in point PAPPU the admin who is the only admin i see on the forum since he is eb3) . So finally we are left to handle the IV Movement movind forward. Now if i was an organizer of a movement i would make sure that all the points made by the organisation is directed towards allaying the concern of people who have been impacted most by retrogration (BTW that would be Eb3 guys and not EB23 who by their god given right have first preference over everything and wil get residency soon because they are a preffered catefgory).
i would classify you as a idT iot if you have NOT realised that from my first post that all i have talking about is "more should be done for EB3" and not "no one is doing anything for EB3". If you have not realised that you are an a person who is blinded by your own Stupidness.
