Having spoken with several congressional aids I can say that such issues are well received. The specific issue that I have raised (it does not affect me) is examples of people leaving USA and having to explain to their US born children why mummy and daddy are not welcome in the USA, and thus why they have to grow up in a foreign country.
I have also given examples of one sibling being born in USA and other aging out.
However, I have only raised this where law makers are known to be sympathetic to family immigration, e.g. support DREAM.
I think that the best we can do is:
Get wait times down (and reduce impact of this).
Use this as an argument with those who support family based immigration (and may even be hostile to EB otherwise).
If we have an opportunity to address this as part of other EB legislation we can.
It is certainly not forgotten by me.
I do think that it would be helpful to have a list of people in IV with this problem (with ages of all children plus relevant dates). For the moment I'm too busy to organize this (busy with IV work -- like 4am bed times).
More active help (not just forum discussion) with IV is always welcome, so you are welcome to step up and help (e.g. compiling a list of such members etc.). Politics is personal so being able to present personal cases is helpful.

A similar concern was raised during the CIS Ombudsman teleconference held on August 16, 2007. But nothing conclusive came out of it. Refer http://www.murthy.com/news/n_ombsci.html
"Other questions included the concern that time spent waiting for the adjudication of one's green card application is not being counted against the standard five-year physical presence requirement to qualify for U.S. citizenship."
Very good reference. I think we need to include this in our agenda for the phase 2 campaign.

So much for increase in fee and supposed increase in efficiency!
May be double the fee justifies 'card production ordered' alert twice....
I e-filed renewal EAD on 5/27, had FP on 6/23 and still waiting any followup action.
With every passing day it looks like USCIS is terribly confused on how to go about per recent 2-yr validity :
1. To approve: 2-yr EAD for those who are not current
2. To approve: 1-yr EAD for those who are current and might get GC in a yr
3. to issue GC instead of EAD for those who are current/ripe/ low-hanging-fruits (I-140 approved/cases processed/no problems)
But, this looks like too much ask for USCIS. They are used to do simple things like: approve or deny and approving everyone for a sinlge time duration.
Let us hope for the best and see what happens in the coming week.

does the new EAD has start date, immidiately after the old EAD exipry date or you lost some days/months in the renewal process?
Start date will immediate the day its approved end date would be 2 Years from the approved date.

Since we now know that SA 187 had nothing to do with immigration and that it WAS indeed passed, the possible typo in this thread (about SA 187) title should be changed to something along the lines "Senate immigration amendment to H.R 2 NOT passed".
Besides we should whoheartedly explore with Kennedy, Kerry et al. if they game for pushing the immigration amendment (w/o the hard 10% country cap) in the house-senate conference.
If they are playing politics with the Sen Session illegal immigrant amendment (which passed!) we might as well use their tete-a-tete to our advantage ;)

but isn't it the best outcome? Now they can precisely set the cut-off date, instead of guessing. that should maximize the visa usage in the following years.
Once USCIS completes data entry of all 800K 485s (may be with in next month) they will have clear picture. They may give a report to DOS, how many waiting in each catagory (EB1,2,3) with PD with countrywise break out. Then DOS will easily setup the cutoff dates. This may happen in Jan or Feb.
I feel that EB3 India may stay like this (in 2001). EB2 India may go back to 2003 or 2002 , based on how many guys in EB3 with PD 2002, 2003 converts to EB2. All other countries may see slight forward movement.

1. You stopped worrying because you got your EAD at least.
2. USCIS is not asking to prove relationship with your great grandparents every time you go for H1B extension
3. You don’t need to worry about the VO at POE or consulate and not postponing your India trip for 3-4 years now.
4. Even though you are on project and pay roll is running, paying the tax...don’t lose your sleep over what memo comes next before the next H1B extension.
Our people are not worrying until it strikes them. Till then they will ask all sorts of questions and have attitude of why should I donate. You can see now and then a thread on IV - Help urgent, I-485 denied, H4- denied.
Why its urgent now for them...?
Totally agree with ya.
Unless crises strikes people and they are shatters they do not care.
Just see the old threads of EAD delays. All these people with EADs were sobbing on those threads pleading to IV to help them. Most did not have a donor status or had contributed a dime. They were on the verge of losing their jobs when IV helped them get their EADs on time. Now where are all those hundreds of people. Are they contributing a dime for the lobby day? I bet after 2 years, they will come again to IV and sob about EADs delays and ask IV to help them.

If each one of us sends 2 letters out, the total letters would be atleast 400-500. More senators are going to be aware of this mess, and atleast 5-6 of them are going to send inquiries. That would just add up to what is already going on.
Flowers on the 10th
Rally on the 14th
Inquiries on the 16th, 18th approx
and finally by then (hope 20th) AILF's CLASS Action Law-suit.

I guess it is time to pack and go back, after seeing all these developments
Here are few sentences from Senator kennedy's concession speach at 1980 Democratic convention in New York
[B]For all those whose cares have been our concern, the work goes on, the cause endures, the hope still lives, and the dream shall never die.[B]
You can hear the speech at http://www.historyplace.com/speeches/tedkennedy.htm
So guys dont get depressed, As long as people like senator kennedy / Mccain are in senate I have hope.
God bless America.

Hi
My wife have H1B approved in 2005.Her stamping was refused on 226(g) section. She came to u.s.a on H4.Now her employer has applied for premium H4 to H1 transfer for her.
We didnot hear anything from them.It is already 2 weeks.
If it goes through.Does she need to go back for stamping to start working.
How the things will be?
How long the process will take (transfer)
If the attorney can help me in this,it is really great and appreicable
thanks

What is 226(g) section? Can you elaborate on why was H1 stamping denied even when you had H1 approval.

Reading your long winded message, I have to question your rationale with respect to your argument and the sneakiness of the message. Your first post with a new id is to plead for re-capture and not work for re-intrepretation of spill over. I have seen this before. Period.
Hi friends,
Let me introduce myself as an EB3 applicant waiting for about 5 years in the line!
Not many will probably be pleased with what I would like state. This calls for some dispassionate introspection.
First of all, let us realize that Green Card is not a right. The rules of the game were clear when we applied and all of us were conscious of what was in store. We all applied with the hope (repeat hope) of settling in the USA. The July 2007 fiasco helped many, including myself, to file 485. The US government went out of its way to accommodate us, rolled back their decision and allowed us to file 485 at that time. We must be eternally thankful for that. There is no need for INS to fear us. We all know how many years it takes to receive a reply from any government office, back home.
To avoid wastage of visas, the INS has formulated some rules and many Indian citizens have been benefitted and will continue to benefit. The nos. have also been made transparent now. The problem with us is that we want more and more and more...Wastage of visas is not of relevance to the INS, it is of relevance to us. It is not fair to question the method of distribution or the rules behind the game. The truth is, we do not have any right to even comment, leave alone question the INS. Let us be clear about that.
It is not not correct to assume that INS rules of distribution have been made arbitrarily. Are we the only intelligent people in the world? Is it that no one has thinking capability? Come on friends, let us be patient and happy for the consideration shown by INS. May be there have been lapses in the past. But which country or which organization / individual has been absolutely infallible? So let us stop blaming and critizing INS.This is a negative approach.
Many Indians seem to get irritated when INS wants to enforce the rules. Nothing will ever happen to people who follow the rules in USA. I do not want to write in a public forum about all the tricks many do, to enter and stay here. Let us all listen to our inner voice.
The real solution would be to plead for a visa recapture. That would be a positive approach. This EB3 / EB2 argument will vertically split the forum. If we EB3 people want to push our agenda, the EB2 folks have a right to counter it and appeal to INS. Afterall, today's world is one of cold and ruthless competition. So, let us not pursue this path.
There are many EB2 candidates who have come to the US way back in 2001, but could file their Labor petitions only in 2006 or 2007 becasue they were forced to do bonded labour by the desi companies. In other words, everyone has had their share of the problems.
My humble request : LET US WORK UNITEDLY AND PLEAD FOR VISA RECAPTURE
EB3 friends, be confident. Everything will work out well!
Best wishes

Actually I saw an improvement for 03/20. 6 approvals for that day then it's back to no approvals.
Looks like approvals has slowed down further.
This is why at the end of the year there are unused visas. All due to inefficiencies of USCIS.
We are doomed.

If there is anything targeted for any small group...I am sure other will not accept whatever may be the reason. Everyone desperately wants to get out of this mess. I dont think freeing up the queue theory will help. Thats the reality.
For the shake of argumennt let me ask you...If I get my GC, it will free up one GC in line. Will you accept that and support this. This is the question in everyone's mind now.
United we stand...divided we fall.
Short answer: of course i will.
Divided, we fall if no one is willing to let another pass for the 'whatever maybe' reason. USCIS is very unlikely to let the gate open for everyone.
At the same time, i know folks who have got their GCs applying after me, because they could (apply) in another category. i only feel Happy about them.
My question is not why they could get it before me, but What reasons USCIS may accept to ease up the queue for us all. It does not seem probable, that they will ease it up all at once. If a certain group is not subjected to the quota - say PhDs (although i do not qualify), it will help my cause as much as others in the wait.
