Rest Of the World [excludes India, China, Mexico and Philippines]
I am wondering what is ROW (in EB3) means?
I see some people wrting EB3 ROW. Looks like it's different from EB3.
I appreciate if some body can explain ROW as used in EB3.
Thank you.

Has anybody tried the new online system? How good is it? Does it give you tracking number, etc? Mor importantly, has it made the process any faster? Thx.
I mistyped my DOB (month and date in reverse order) in application, I expected it will let me correct. But it confirmed and generated the file #. I called them how to correct, they have no idea since it is new to them. Finally one officer over phone told to write a covering letter explaining the problem along with application.
So BE CAREFUL while entering the important data. Once you click on the Submit, and OK for popup buttons it is done. No separate confirmation page. The same entry page gives a popup to confirm changes, if you Ok it thats it. File is generated. Mailed mine on 4/17/08 and praying to God. I'll call them next week.

Hello, Thanks for the help. Here is my list.
1. As CIS told Congress in a hearing last year, They indeed wasted visas due to administrative delays. Clearing such a backlog would make all EB current. - Best case scenario
2. Allowing people to file Adjustment of Status (AOS) after their immigration petition (I140) is approved but were unable due to their country cap. Relax/clarify the AC-21 rule for Same or Similar occupation. How much long wait is considered long enough to move-on? (in general terms) - Average Scenario
3. Let CIS publish the real backlog of the EB AOS applications (Backlog defined by common sense - should include all the EB AOS cases and not just what they think not backedup due to Visa availability) pending by country, and PD in 2-3 months. - Worst case Scenario. Atleast helps us plan our future by deciding to continue the wait or get back home.
4. Starting the Citizenship clock after I140 approved.
Thanks again for your help..

"IV Professional Network" is a great idea... are you thinking inthe line of NetIP???
for that should we not think of new sister website! with a link provided on thru IV website!
--
Good point.
Just to let you know, I have spoken to our counterparts at NETIP, at that time they were having their annual convention and after that we got busy with our DC rally. Thanks for reminding, this is an area worth exploring again. Are you an NETIP member? Maybe, you can help us facilitate this partnership. PM me your ph # and we can talk.

> On the same note guys..Nothing changes after GC.
Actually, it does. If you get a GC, you have the option to get citizenship in 5 yrs. If
you get citizenship, you can get Social security.....irrespective of whether you live in
US or in Timbaktu. So IMO, the biggest advantage of GC is getting back the money
you've been paying as part of Social security taxes.
And for those of you who think Social Security will run bankrupt....that will never happen,
or the US president will lose his job. The Govt will always fund SS even if it means
increasing a ballooning deficit.
Not only do you get SS but you also have to pay taxes to US irrespective of where you live for the rest of your life. So on a net it is still arguable depending on your long term residency plan. And my friend, Social Security is going away in the next 10 years. You think the USA can maintain this kind of a deficit for ever with people not willing to see an increase in taxes.

Susie, I can say quite strongly that IV's agenda is quite officially
"H1B quota is not an issue that we wish to take any sides on".
We are trying to reduce the backlogs as a primary goal.
The main aim is to reduce the backlogs which will also reduce the age out problem, but not fix for those already aged out. Believe me, even if this was the only issue on the agenda, it is hard enough to get this done.
If we don't fix the backlogs then age out will be irrelevant. Let's imagine that H1B quota is increased, and EB3 ROW never becomes current because of more H1B ROW newbies. Then EB3 India will never get any spill over. In this case new India EB3 applications could easily have a 25 year wait, by which time the primary petitioner will have retired invalidating the whole application. Thus you can see that increasing H1B quota works against us (although the official position is no position).
I am considering computer modeling this, because I think that the a 25 year wait is very possible with the current scheme (making age out easier to push maybe).
If there is an opportunity to provide ago out protection without risking the main aim then I think that it will be taken. First we need a seat at the negotiating table.
Until we get a seat at the table we have the trade off between raising age out complicates things, and raising age out keeps it personal. There has been some debate over the, I think that the professionals recommend "keep it simple".
My position on this is to raise the age out and other family issues like US citizen children being forced to leave because their parents are. But only raise it with those law makers it will clearly be received well with, and not be a distraction.
There are other issues worthy of targeting, but they too complicate things, and risk us not getting a seat at the table. For example banning consulting. This could force many to leave, including their children, through not fault of their own. I think that consulting should at very least be grandfathered, and have some other exceptions. But again pushing that would be a distraction.
As I said, if we get a seat at the table, this issue has a chance.
We are currently working on getting that seat.
Thanks for your post, support and understanding as you know many H1B children still age out as do many other children who entered the us legally.
I am so passionate about this issue if iv decide to do something I would help in any way I could

My employer filed my EB3 PERM on 65th day after starting the process with a job bank posting, and after filing with DOL it took 11 days for the lawyer to receive the approval.
My employer filed Labor 90 days after the job posting (6 months after I initiated the process, this is after being screwed by my previous employer for 2 years)...Labor was aproved in less than 45 hours!!!

Like it or not In legal language you become more so called bright in EB2. If you apply in EB1 you upgrade your so called brightness. It does not matter in reality who you are. But as far as law goes for EB1, EB2 and EB3 etc it prioritizes based on qualifications needed for performing the job function. Our employers and lawyers decide on those requirements. Have you questioned those requirements?
Maybe if we had questioned those requirements laid down by employer and lawyers, more people would be in EB2.
Yes you are absolutely right, had we questioned, then some of the brighter and brightest wouldn't have been legally brighter and brightest (would have had to experience downgrade of their brightness). Most of the brighter and brightest wouldn't have even got into the path / line to become brighter and brightest. Since you are in legally brighter side I am afraid that you won't be able to comprehend the issue and solution of less legally brighter ones.

I guess, the question now is weather INS will put application on hold and request an Xray after her giving birth or just let it go completely...
We'll see.

I have contributed $320/- so far and just now signed up for $20/- per month. But I would definitely raise that amount very soon. Though I have contributed through other ways also besides financial contribution, at this moment this is the least I can do for myself and I am doing it.

Please post the name of your company. I would request IV to setup a webfax so that all of us can send webfaxes to such employers to stop this exploitation. The copy of the webfax should also be sent to DOL and USCIS (with the name of such companies) each time it is sent to the company. We should jam the fax machine of DOL, USCIS and such companies. If we do this to 5-10 employers, all others will behave.
Seems like a good idea but doesn't this make them even mad and jeopardize the chances of the employee even more ???

I just found Feb 08 Stats (http://www.uscis.gov/files/article/APPLICATIONS%20FOR%20IMMIGRATION%20BENEFITS_Februa ry08.pdf) and in Feb 08 there were 787,516 I-485 cases pending. So this might be good news that the backlog is reducing?
Those 197k ( approx ) reduction could be from family based AOS.. until we get data from FOIA , we cannot relay on their information.. Its so broad range of figures they post.
Again who knows when they send us FOAI response.
