I think Kerry(i think it is actually Kennedy E who introduced it - SA180 , SA 187 did not have anyhting to do with us it was for Women centers) di dnot have any good intentions for us in troducing this.If you see on Thomas(or congress.gov and search for HR2, see the fourth version, and check out amendments), SA180 was amendment to SA143 (this is by our friend Jeff Sessions). So most probably it was part of politics. Also this status says both these amendments wer eintroduced in Senate but thats it, they did not pass.

Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.
Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.
Me and husband will attend and also contribute. Will wait to register until get approval for time off from job. Any one going to DC from Baltimore can contact me so we can arrange car pool.

Booked tickets (4) - to travel on Jun 6th - 3 months ago. didn't expect dates will move.
Now, I know when filing is done on Jun 1 ( attorney said), we have to be in US.
Q1: Do we have to wait for receipt to be received by attorney and /or me?
Q2: From filing date, how long it will take to get the receipt? One day, two days , one week or two weeks or more.

My lawyer says that if you apply for EAD and AP at the same time then you need to remain in the country until these come through. As for 485, the only issue is FP notice. You will need to be in the country to do this. However, you can file to reschedule within 84 days of the FP notice if you are out of the country.

I agree with (2) and would also like to point out that the risks are also substantial. One can get addicted to day trading and I dont need to tell what addiction can do to any one. It needs time during work hours. ie 9 30 am and 4 30 pm. A lot of people did day trading during the dot com boom and recently with FRE & FNM. We know the results.

How do you know that this year quota finished on first day because of �Indian Companies�? Do you have any proof to support your blame? And what is �Indian consulting firms�? Why is it ok for one group of companies to file for H1 and not ok for another group of companies to file H1? Why is it �UNFAIR� for consulting companies to take large number of H1 quota? Isn�t H1 considered to be for the �best and the brightest�? Wouldn�t it make more useful for the �best and the brightest� to provide solutions to many companies at the same time by working for consulting companies? Why discriminate against consulting industry?
Here is some information that may help you gauge the reality. There is lot of companies in US that would not fit into your definition of �Indian Companies�. These companies have filed for large number of H1s that too would have finished the H1 quota. If it is ok for an H1 employee to work for a shoe making company, then why is it �UNFAIR� for H1 employee to work for a consulting company?
Bottom line is:
1.) There is green card backlog for 6-10 yr. Any company would love to get an insurance policy that an employee will work for them for that long period. So one reason for this quest for H1 is due to delays in green card processing. If someone gets their greencard in 1-2 yrs., H1 visa approval will not get the employers any insurance policy for long term employee. And the demand for H1 due to this factor would subside.
2.) More importantly, even if demand for H1 would subside due to green card processing in 1-2 yr, the fact that unemployment rate is very low will still exist. Unemployment rate is making it hard for companies to find the right people at the right time at the right place. So companies are looking for ways to recruit the necessary talent, wherever that talent is available. IEEE wants all foreign engineers out of the country so that their membership base of engineers here, who do not want to learn new technology, could get the taste of late 90s. So for you to first attack a set of consulting companies and then cheer around the bill hoping that �the changes going to be introduced to fix the system will not screw us and complicate more the immigration process.� is exactly how it is going to play out. Infact, anti-immigrants will come to this site and cut-paste comments like yours into their report to strengthen their argument when they would go out to lobby in favor of this bill. Also, I see a racist attitude in this bill against the huge consulting industry. I thought visa numbers are available equally per quarter and DOS is prevented from releasing numbers early. How can they say that all the visa numbers have been used (or will be used by April end)?

My sense is that many of them don't understand the issues very well.

One recurring theme however. It is so ridiculous. Each year, straight out of the gate TSC starts pumping out approvals, while NSC sits on their rear ends doing squat.
Considering this has been the recurring theme for the past 3 yrs, I am certain that NSC has the older PD cases, but just uses those files to be great seat cushions.
Then as will inevitably be the case the numbers will be used up and, the music will stop and everyone at NSC gets frozen out.
This is a trend happening each year and is very unfair to NSC filers.
Do we have any data on this issue. NSC productivity vs TSC productivity compared to 485 cases pending?

As I said before, IV should step up for EB3-I/C/ROW cause since policies seem to be working in favor of other EBs (which is good) but EB3 is stuck..
Here are some paths to consider.
1. IV has established relationships with some key politicians through the advocacy days, may be that channel can work
or
2. Allow interfiling with spouse
or
3. Allow folks to file I-485 for an approved I-140 even if the dates are not current
or
4. Have an endless EAD and AP (by endless I mean 5 years)
or
5. Recapture (Tie it to a bill...eg Zoe Lofgren or Feigngold will not sign Finance reform bill unless lost EB visas are recaptured). It will help EB2 folks as well. Give Feingold a call, he is voting no on Finance reform. May be he can kick in something for legal EB folks (similar to cornhusker) and may vote Yes and be the 60th vote.
What I suggest you guys to do is build upon these ideas above rather than destroy it or be sarcastic about it.
They certainly need to consider joining other groups....
Immigrationforamerica, immigrantlist, etc. Just tie up with a few politicization won't cut it, I think.
Some relief, if they consider wait period is counted towards citizenship eligibility.

Agreed. But also please note that there is nothing called "GOOD FAITH". Just making a law is enough. It is US INS responsibility to ensure no one (mostly Indian IT companies and small companies in US operated from bedrooms, not basement or garage!! :) those created in garage are HP and GOOGLE) can exploit it. So blaming TCS and WIPRO and INFY and PATNI is not enough!! If we don't protect our house and thief exploits that to rob us that is our fault. This holds true for US INS too. And don't assume INS didn't know this. No exploitation is possible without Govt's active or passive approval. This is one big ecosystem and all have their share. That is how all businesses are operated across the world. Immigration is one of the biggest businesses here. And they want this chaos to exist for their interests.
I think it is the Big Fish , that needs to be blamed. With the Visa fee at the levels it is today , small time companies can't afford to apply thousands of visas just like that , where as your Infys and wipros coud do.

I just have one request - can we eliminate the fact that our PD has to become current to apply for AOS, so that dependents of 485 filed members who have still not filed 485 can file now and atleast get a EAD/AP/SSN and they can start their careers. This should not be that tough, since anyway one day they got to file and it also brings money to USCIS.
So my request is,

First, I am not promising to solve anything. I am just saying that I will bring up the issues when I have my meeting. If this thread is a distraction, then feel free to ignore it.
Second, those who have participated in this forum over the past year know about the issues I was working on.

I am not sure what the point is about "innocent Indians." Does it really matter if I am Canadian? Is this forum restricted to South Asians?
