If you and your spouse have good jobs here and children are in school....moving back to support your parents may not be so feasible both economically and also for many other reasons. Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .

That is why when you feel like venting out you need to really select people that are more compassionate. No one expects a pity party, but at the same time no one should trivialize something as serious as this or give "advice" that is idiotic and that even they, had they been in this situation, would not do. I feel terrible for your friend because he has such education and is stuck like this. It feels like you're wasting the best years of your life just waiting. Gave in and sent PP by Fedex yesterday for Schedule A, grp 2 case.My attorney did not advise me to PP nor did a legally brain I turn to for advice. He said its likely that I would get approved even during retrogression.
But I decided its better to know sooner than later, preferably before spouse started using EAD, and if a miracle happens (who can prevent miracles?) the 485 could also get approved concurrently with the 140.... And because I have 13 days more before retrogression hits. And because I saw people reportiing really qiuck turn around after PP. My employer was willing to pay half as well...
Well plus I did not want to be stuck in the general EB2 pool (India) which looks like its a black hole. I have an approved labor from 2004 there.(yet to file 140 for that one)..so didn't see a reason to be stuck there with a 2006 PD.
I still wonder if my reasons were sane and if my hasty action mght prevent my spouse from working -- if the 140 gets denied...Well, we'll take it as it comes..it may mean goodbye to the US or something..
BTW as far as I know, retrogression doesn't start till November 1st.

Just because somebody's plans worked well , and some body's wife is happy staying home , all those GC chasers are now fools.
There are areas in USA where there is no appreciation at all in the real estate market , and not everybody is lucky enough to get the jobs immediately after coming on to the bench ., on H1B VISA.
In my opinion , 90% of the people on this forum have got all plans and ideas on what to do if there is no GC.But 100% of the peoples plans will be more successful ..if there is GC in hand.

For those who think assisting US economy by buy houses (for pending GC applicants) is like selling a GC are just plain dumb! No wonder why we dont have a resolution to the 10 yr waiting that's been killing EB immigrants, is because ppl like you, who love to take pain want others to live through this for the lifetime.....................

Change the language and target too. I am thinking to draft a letter to send Home Builder Assoc and Car companies that I am not able to buy Home and Car because I am not getting loan. I need a car and home as I am paying rent every month around 1500. I am willing to pay 25% down and have credit score more than 700. No any kind of violation. Paied off first car loan. I am experienced enough to find another job in such bad economy. The only thing that I dont have is GC for which I am waiting for last 8 years. If I get GC probably I will get good loan faster and cheaper. If you lobby for us for GC probably not only me many other immigrant will get loans.
Never ever mention that it will improve economy.

Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?
However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???
This is not clear for retaining a priority date when I-140 is revoked. As per a US CIS memorandum, when I-140 is revoked for misrepresentation or fraud, person won't be able to carry the PD over. On the other hand, there are regulations that state that beneficiary would no longer be able to carry over the priority date in the event of I-140 being revoked.
Please note that the memorandum does not have the force of law.

The poor response is because we are not together and we truly do not believe in our goal. With the assumption that 90% of IV members are Indians, I can safely say this is innate in our culture - we want to get the benefit without working for it AND once we get the benefit, we give a damn about the rest of "them". :mad:
Just my 2 cents here: Our culture has its place. Being conservative with our money has served us very well today so let us not disparage it. For raising funds from our community we should have more convincing behavior, actions and arguments. Generating trust and goodwill is very important.
To get peoples' trust it is important to be patient and welcome questions and respect others' views, and always answer in best manner possible. Unfortunately there are a few immature elements that spoil the atmosphere here. Maybe we should have some amount of moderation, to cut out the unwanted speeches

You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.

He was always wanting to go back to India but because of the conditions of Indians, he was urged to stay back and help them, he actually went back in between and again came back to SA for a more organized effort.
The situation now is different. The Durbin Grassely bill lobbyists are basically doing what has been happening in UK where local population do not want Asian immigrants taking high paying challenging jobs in their own soil. They don't seem to care if these jobs go away because the effect will be long term and as such it is a known fact that in these days, we seldom see the immigrant community having a good cooperation, every immigrant feels that one less immigrant, it is good for him.
This has been happening in every country where highly skilled migrants take job positions in countries like Aus, NZ, UK, Germany etc..
The US system is harder to crack for anti immigrants than these countries. So they follow this slow bleed approach. On the long run their objectives will be met though it would force out high skilled jobs abroad.
One good thing is that developing nations must capitulate on this and make their labor laws good and also copyright laws and patent laws so that innovation and products are developed in developing nations and so called developed nations will bleed technology and innovation.

By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?

Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.
85 % of the fortune 500 CEOs are not MBAs. And the other 15% that have an MBA, only 3 of the 15 have done MBA from an IVY LEAGUE school.
What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.
The biggest prize goes NOT TO people who can follow directions and know everything, but who can GIVE directions and get things done.
It's like saying if I owned only one company's stock then I could be the richest person in world. Why do people diversify among stocks and then bonds? The moment you diversify you lose your chance to become the richest person in world.
A higher education betters your risk assessment. Your statistics may be correct but what your numbers don't say is the opposite side of coin? What is the percentage of people who don't have high school degree and earn less than $100,000 at the age of 35? Now what is that percentage for MBAs? What is the percentage of people who don't have at least a bachelors degree and are better than Project Manager by age of 35? Now what is that percentage for those who have at least a bachelors? The reason Sachin Tendulkar cannot hit fastest century but can score many centuries is because he is properly trained. He can assess risk better than Shahid Afridi can. Even though Shahid Afridi once had fastest century he was nowhere close to Sachin. Finally, a look at GM and Ford history from 1920 to 1940reveals the reason behind a need for a better risk assessment.
I don't see why everyone should strive to be the richest person or C-person in the world. Everyone has different value system. Some may like 9 to 5 job because they can enjoy other things in life... like lying down on beach, watching your child take first few steps, etc. Some moments never return in one's life.
I work with different Managing Directors, they earn a decent $250+ salaries but none of them even want to become CEO or for that matter any C-titled manager. I know one MD, in early 50s, who passed the C job because he wanted to go fishing with his 4 sons at his vacation home in New England... At that time he told me, "Once these bastards leave me I guess I will cherish spending time with them fishing at my vacation home more than counting big dollars in my bank account".
