Regd conversion to PERM ie refile in PERM and retain the PD your title, minimum job requirements, employer's name, employer's address etc should remain the same except the prevailing wage.
Some of the factors to consider before refiling:
1)Length of time the traditional or RIR Labor certification application has been pending: If you feel that traditional or RIR will be certified soon don't refile in PERM else do it.
2)Alien requiring a seventh-year extension:
It is uncertain at this time whethre USCIS will permit the alien to withdraw the labor certification and retain the PD date for the purpose of replying on the provision under AC21 to obtain a seventh-year extension. Until USCIS pronounces a clear policy in this area, one should proceed with extreme caution before refiling under the PERM regulatoins.
3)Economic factor like Layoffs in the industry, Recent layoffs by employer, increased costs for the employer

You will have to be ready for her return to India ASAP if her extension petition is denied, as she might start incurring illegal stay, which might create hindrance for her next visit or her next VISA application.
It would be a good idea to state about her anticipated visit to other states etc. instead of other reason.
It is likely that she might get RFE, but it should all be answerable.

Hi.
I have an urgent need. My wife is a green card holder and we just finished visiting my family here in the US before we travel overseas tomorrow to visit my wife's family. The problem is my wife left her purse (along with her green card) at my family's house but my family is now out of town themselves for a few weeks and we can't get into the house to get her purse and green card. Luckily she left her passport at our hotel so we still have that.
My question is---can we still leave the US tomorrow without my wife's green card? Does she need to show her green card to leave US? Her country of origin passport is still valid but her immigrant visa is expired.
I can ask my family to fedex us the green card overseas once they return so we can reeneter the US when our trip is finished.

Check with your attorney , But I 'm quiet sure that to to port the date your first 140 need to be approved. Since it is denied (although it is lawyer's mistake) you are out of luck.

I have sent a message to president Obama requesting his help by issuing executive order either to increase per country cap temporarily atleast till the EB backlogs gets over for india and china
OR
Issue executive order to allow visa re-capture to utilize wasted immigrant visas
i am waiting for the reply . i am not sure if i will be heard .
I had sent similar message to my senators requesting them to support the visa recapture bill . i got a call today from his asistant . He said they understand the issue and the senator is supporting the CIR this year . i told him that wont help the skilled immigrants, he said that the provisions with relief for legal skilled immigrants will be added into that CIR and passed .
when i asked him why not do a piece meal approach and pass smaller bills like visa re-capture etc.. his reply was that the anti immigrant groups will basicall y kill the bill . so he said that it is better to wait for CIR hopefully this year.
I said thank you for response and hungup the phone.
so bottom line is i guess we have to wait for CIR and if any good will comeout from that for EB categories.

After the stab at Sony that Canon made in the press release stating they were releasing ~ 20 cameras this year, you don't think they'd let Sony get that far ahead, do you? :p
In my opinion, one of the more intriguing product announcements from Nikon today was the Coolpix 8700. If it improves significantly from the Sony, that could be a killer product. Right now, Canon is lacking a bit in the true consumer DSLR market. But then again, PMA is right around the corner. i agree with the above poster. It really should be done in WPF. There are ways to make your own window, but it is hell, and i mean lots of hell. You would have to create a base object that is fully transparent that is where your window is located, then draw on the different areas, but then you need to keep track of those areas for mouse events, and bind the right clicks to the events.
In short, WPF is what you want. The win32 gui is a thing of the past. Some places might still use it, that is only because they dont know wpf yet.

Q1. should i file under "Spouse of U.S. citizen/resident alien" or "Dependent/spouse of a nonresident alien holding a U.S. visa".
Q2. what are the documents I need to submit with the W-7 form.
Q3. is ITIN application only possible during tax return filing or I can apply and get the ITIN number early and then use it during my tax filing.

You cannot travel and enter US with expired AP. Please renew your AP. Stamp on AP cannot make any difference as per my knowledge. You will have your I-94 also with same time stamp.

I have my I 140 approved in 2006 and it has priority date. Filed my I 485 in August 2007. The priority date in the receipt is blank, guess looks to be normal.

I saw that too, but my problem is that i already had an appt for 3rd week of dec but I had an issue with my passport. Had to send papers for getting my name changed to my married name on the passport as the latest I797 i received was on my married name (noticed this only recently). Now I cannot change the name, passport etc on an existing appointment so will have to cancel the one I have. And currently only emergency appts are available for 3rd and 4th week of dec. Hence the dilemma!!!!!
