I think it works well from both angles (visitor, citizen of India) after the new rules. I am not sure why people were allowed to enter on travel visas if they were clearly coming for business.

It is is 5 years for all Family based except marriage to US Citizen (where it is 3 years).
It is NOT 3 years after conditional residence - It is a total of 3 years.

There is nothing called "H1b transfer" basically every company applies new H1b but it is within quota and you can have multiple companies holding your h1b visa but you can work only for one company on full time rest part time and there is no need cancel H1b, just go and join the company you want to join. sorry to hear about your job loss. AP are supposed to be used during emergencies and it seems you are only planning for a week visit, seems perfect for AP use.
I have used AP many times, never had any problem, most recent visit being in Jan 2009.
H1B is having lot of problems in getting stamped and at POE, but I haven't heard anything like that for AP travelers. Just remember that if I485 is denied for whatever reason, AP also gets invalidated(Meaning out-of-country AP holders won't be able to return!!!!).
I would say go ahead travel on AP. How long can one put life on hold for GC. Its ridiculous.
File AC21 at the soonest to avoid getting denial.

Yeah. Mention the company's name that filed GC for you/wife. I did the same for my wife. During the interview we both were asked about whether employer had filed for our GC and we said yes. We got the visa, no issues whatsoever.

Nothing! This bill passed the Senate a month before they started the CIR. Cornyn introduced the SKIL act and then he immediately withdrew it because he was hoping that it will become part of the future Immigration bill. Later on the CIR failed and we are left with nothing again.

I just received an email from USCIS saying that my I-140 has been denied. I touched base with the attorney & she has not yet received any documentation from USCIS. This has been the 1st change in my status since Aug 07. My case is pending at TSC.
Does anyone know if this is a fairly common occurance for USCIS to deny I-140 without an RFE? Any advise on what to do next?

Tourist visa is for tourism purpose only. You want advice to misuse the visa ?. 10 year multiple entry visa can be used number of times. But she stays more (like 6 month max) for each visit, after 2 such visit, within a small gap say 2-6 months, there is a chancce to blacklist her and may be allow for 1-2 months I-94, or deny her entry. They are smart to see the intension of people. They look for the pattern of visit.

How about working on an EAD in a part-time job while working full-time on your h1 sponsored job? I assume the h1 will not become invalid in this case because EAD is being used for the part time job.

Once the part time employer uses your EAD card to give you a job basically he has to submit that info to the INS and that will automatically invalidate your H1 status. This EAD which u received is for allowing you to work which the change of status from H1 to green card is taking place.

Dear Friends,
I have changed my employer after 180 days of my pending I-485. I have not communicated USCIS about this. I was able to renew my EAD, and AP online with proper documentation without any issues.
I am planning to travel to India on Advance Parole now. Wondering if I can show my former employer's documentation such as I-485, I-140 approvals if anything arises while going or returning. Do you anticipate any issues with this? or do I need to carry any information about current employer, and my Job?. Appreciate your help.

With so many proposals and so many amendments to the so many proposals (:rolleyes: ), which one would actually (or at least help to) eliminate the current backlogs (i.e., make the priority date current)? :confused:
We should make sure that any bill that potentially becomes a law will resolve the current retrogression issue (instead of making it worse).
So before we decide the bill to support, can anyone tell which bill will eliminate retrogression? Maybe we can categorize all the bills into the following types:
1. Will definitely eliminate retrogression if the bill becomes law
2. May eliminate retrogression or may make it worse if the bill becomes law
3. Will definitely make retrogression worse if the bill becomes law
4. Will have no impact on retrogression if the bill becomes law

During this tough times of un-employment, it is very unfortunate that many of us lose our jobs. As a result many of us lose medical benefits too. I would like to explore our options for medical insurance (which is the most needed) for someone who lost their jobs and cannot afford COBRA coverage since it is very expensive. I recently got married and am back in the US. My wife is employed in India and shall be filing for her H1 this year(Apr08).
At the same time,given the unsurity of H1,we shall also be going for her H4 Visas in Mar-Apr so that she can be here in the US,ASAP.
I have a few doubts/questions:
1) Since her H1 would be filed on April 1st,do I need to wait till April 1st before going for her H4 so that her application stands clean ?
and
If I go for her H4 before April 1st(say March 29th),does her H1 filing need the H4 details ?
Also,assuming during her H1 filing she didnt have H4 and then gets her H4(say on Apr 2nd) and comes to the US. Assuming her H1 gets approved,does she have to leave the country and get her H1 stamped for change of Visa from H4 to H1(note at the time of H1 application she didnt have her H4 Visas) ?
