    One of my friends went for his fingerprint appointment a few days earlier than the scheduled date. He had no problems at the USCIS office, so I guess you just go there anyday you are free and you should be all set.

    Depends on the USCIS office and how busy they are.
    My wife's FP in Minneapolis was one day before mine, so I went along to hers hoping to do mine too and save myself the extra trip, they told me they are behind schedule and can't take any walk-ins that period and I had to come back in my scheduled day.

    This is verry pertinent. If you both are working on EAD , you are no longer on H1. How can the baby come back on H4?

    If you really need your wife to go to India, I suggest taking opinion with attorney, since the ability for the baby to come back might be an issue.

    My current EAD (based on I-485 application) is expiring on Aug 20th. I applied for the renewal only last month and have not received any approval yet.
    As far as my history goes, I was on H1B from 2002 to 2006 and started using my first EAD processed through my husband's green card. Subsequently I renewed my EAD once and I changed employer once. I just received case status update on I-485 that "card production has been ordered and will take upto 30 days". :) I am afraid that my work eligibility status expires on aug 20 and i will be able to work if my EAD doesnt arrive by aug 20th and my GC doesnt arrive or is delayed for any other reason.:(

    So What are my options to continue to work in the meantime? Can i ask my employer to file a new H1B for me now and start working on that? :confused:

    To apply AC21 what lawyer needs to do? Just file G28? or ther any other documents required from original employer?



    Nothing is required from the original employer. If you can get a letter of intent from the new employer confirming that it wants to hire you permanently and describing your new job as same or similar to the old job, submit it to the USCIS. But do not worry too much if you cannot get it, it's not required.

    Do people really care?


    A reputed local channel is producing a documentary on the contributions of the immigrants to the economy and the difficulties they have to face and have to overcome to survive here and Highly Skilled Legal Immigrant group will be one of the three groups they will be focusing on. Pdakwala one of the co founders of IV has been working with the channel to make sure that there is coverage of the challenges we the Highly Skilled Legal Immigrants are facing due to the present outdated immigration process.
    My wife and me both Highly Skilled Legal Immigrants will be a part of this documentary. What I intend to do is ....to send a detailed document to the producers mentioning three points so that they have a clear understanding of the contributions we make and the issues we are facing

    1. The economic and cultural contributions the HSLI's make.
    2. The Competitive advantage this country will lose if it does not make immediate amendments to the broken Immigration process.
    3. Debunk some myths such as H1's dont pay tax, H1's take away jobs etc

    I know I can find sufficient information if I browse through the various threads of IV but I am posting this for two reasons

    1. I want input in terms of how to eloberate this specially point 2 and point 3
    2. Constrain of time -- I need to send out the information like ...yesterday ;)

    Hi Polsanicm,

    So what is your submission date return on receipt of notice for H4 Submission ?
    Also, have you got any NTA notice to appear in court coz mine is in June 1st week and had applied for F1 to H4 on 3rd Feb but has not receive anything as of yet.
    When I called USCIs they said they were working for cases on 16 Jan as of today, which they are saying for last 2-3 weeks.

    -------------------------------------EASIEST WAYS TO GET GC--------------------------------------

    1. If you are still not married, marry a USC and I am saying marry a USC for genuine reasons not for GC.

    That way both purposes will be solved. You may get a good spouse & bonus GC within no time.

    2. Study till you get a PHD. Look for an employer who wants you. File under EB1.

    3. Invest some $5-10 million in rural US & get GC in EB-5 (or EB-4 donno which one exactly)

    4. Slightly longer but still better than current EB3/EB2-I, die early, pray to god that u be born as child of a USC or at least pray to be not born as Indian/Chinese/Mexican or a Fillipino.

    Just kidding..Though 1st 2 options are genuine & valid. Do not waste your time & energy as to understanding why retrogression happened, why dates move back & forth etc etc.

    Indian govt doesnt about you and me. They are caring about the slave masters and remember Nascom proposed another visa where you can not apply for GC. All they care is how to tighten their grib on you and suck more blood.

    Self employment has to conform to the stipulations of AC21.

    A baker can start his own small business, as long as he is still a baker. But if he positions himself as CEO or a vice-president, then he is asking for trouble.

    The other factor is the future job offer letter if you are not already in that position. if P has his own business and is making 2x where x is the salary for the future job, how will an IO believe P has the intent of giving up his lucative business and moving to employment for half the income?

    Like someone said above, it is all about intent. The basic question it boils down to is this - Do you really have the intent of working for your sponsoring employer or are you using him as a green card shop?

    - 5 SRs (4 no response, 1 useless response)

    - 2 Fax to NSC director with no response
    - 2 letters to NSC director with no response
    - 5 letters to congressmen and senators
    - 1 letter to First Lady
    - 1 response from FBI regarding name check.
    - 2 Ombudsman enquiry (1 no response, 1 useless response)
    - 2 responses from USCIS to congressmen enquiry (promising i'll get something before Oct 2008)
    - 2 more followup enquiry to Congressmen (because nothing happend until Nov 1st week)
    - 2 more followup response from USCIS (promising some status change before Nov 30th)
    - 1 I-485 RFE (just before Nov 30th as they promised)
    - Numberous phone calls to NSC

    RFE received on 11/24, RFE response recd 12/01

    12/04 GC approved.

    Regarding my H1, My in-laws came to visit us (and some other personel reasons too) I did not started work in October. So I requested my employer to extend my start date to May 2008. Mean while I got job at the current place using EAD. I started using EAD in April - 2008.

    I think COBRA (http://en.wikipedia.org/wiki/Consolidated_Omnibus_Budget_Reconciliation_Act_of_ 1985) applies in your case. So, you could continue your previous coverage for a certain period of time - usually 18 months. However, the catch is that you'd have to pay slightly more (usually 102% of) than the entire negotiated premium between your employer and insurance. So, say you might pay $200/month out of pocket for your coverage and your employer pays the rest of the premium (e.g., $600/month). Under COBRA, you'd have to pay slightly more than $800/month to continue the same coverage. I've heard there are cheaper insurance available elsewhere but in quite a few of them maternity is an "optional benefit" - whatever it means. So, you might have to search for it online and call individual insurance companies to find out more.

    When you talk about an existing infant and maternity, I'd be very careful about buying an insurance on my own - not saying you can't do that but you just need to read the fine prints very carefully so that you're not in for a BIG and unpleasant surprise down the pike.

    Do not send originals back. My company lawyer sent it to them last year (after keeping certified copies) and it has has not came back yet. They do not issue any new receipt numbers and there is no way to track it. Lawyer also did the inquiry thru AILA but nothing happened.
