"ADJUSTMENT OF STATUS ON THE BASIS OF EARNED ACCESS TO LEGALIZATION"

Hi,
I and my spouse are both on H1 and have our EADs as well. I have an oppurtunity for a side project. Is it possible for me to use EAD for this project alone and continue with my primary employer on H1? (I am not the primary applicant for the GC and am a beneficiary for the EAD)

A real 101 question
1. My friend has his labor approved 09/2007. Priority dates not known but he applied in august 2007.
2. He will be applying for I 140.
a. Can he apply thro� premium processing for 140? Is this channel open or still closed? Does anyone have a news on this one?
This channel is closed , no one has an idea if USCIS reinstates prem. processing anytime soon
b. Can he apply for I 140 next week? Is USCIS still taking applications for I 140 (thro� normal processing)

c. If answer to question 2*b is yes. How fast that can be done?

d. Real question is now : If he applies for I 140 will he be able to extend his H1 beyond 6 yrs? His visa is ending on Dec 23, 2007.

Hi, I'm a Georgia (Fulton County) high school senior applying for college soon for the fall 2008 semester.
My family is on the H series visa and has been for the past 7 years. My father has filed for I-485 in August of this year, but it is still pending. Our priority date is somewhere late 2004, september I think.
Since I'm unsure whether I'm gonna be an eligible non-citizen (green card) for financial aid by the time I apply, would Georgia laws require I pay out of state or is there any chance of me getting in state?
We have lived in Georgia since July 2006.
Any help would be appreciated.. thank you..

If you were here and did your schooling in GA school, you are considered as in state.
Please be aware instate does not mean you get all the concessions and aid which are applicable to citizens. Mostly Aid and asst ship depends on your university profressor and related department staff. If they like you and you maintain your grade then you will be getting most of the aid you wanted till you complete your studies. I know some who got aid with H4 status. I have enquired about all these for my daughter's admission in GA Tech.
As other members suggested bottom line is - it all depends on School and related professor.

Apahilaj, you may be right, it is straight forward in case of AP but with EAD it is spinning around. As per the instructions at page 9, it is leading to TSC address. I prefer you to call them to set this straight. Please accept my sincere apologies if I had given any incorrect info in this regard.
Update -- I called USCIS today and the rep told me that I should have sent this application to chicago lockbox address...She said that it depends on question 16 which I said I have mentioned C09 category. She said that it will most likely be rejected and sent back to you or Texas center may forward the application to the correct address..

Cant you get H1 transfer and still work for the other employer?
i still think it's best to apply for ead so you can work for another company if you plan to change job after 180 days. your h1 visa only allows you to work for the sponsoring company. just my opinion.

I have not completed my MS and changed my status to H-1B after 2 semesters and since then I am working on H-1B I have almost all the paystubs except the starting three months of H1 when i was unable to get on project which also means that i don't have W-2 for that year, however since then i have all the paystubs and two years W-2, I have changed my employer and now have H-1B valid till 2010 but still I am very scared to go for stamping.
Anyone in this situation and can suggest me what can i do so that stamping for me can be smooth and hassle free.Here again is a gist of case for better suggestions
1)I have bachelors degree in computer science from India
2)I Reported to my Schools International office that I have got a good opportunity in my field so I am leaving F-1 status and also gave her a copy of my H-1 approval
3)Just to be on safe side i have enrolled in one class till october 1 and then dropped it since my H-1 started on OCT 1
4) Have 2 years W-2 and latest pay stubs
5) I have Advance parole but don't want to use it because I am not married and might get problems in getting H-4 for my would be wife
My Worries:

1. people whose's PD is now CURRENT. they do not want more people to be CURRENT when their case is still pending.
2. People who are EB3. which is not going to move at all.
3. IV member who are not interested in pushing PD for the time being. People like June, 2006, July 2006 is not their interest to help.

We will be talking to the Lawyers, one of the objective of this post was to get enough information to educate ourselves and prepare appropriate questions for the lawyer.
if he is part of that company for three Years and in that if he is a manager for an year, he will be eligibile for L1A. Then can apply GC without labor and should be able to get GC in 1 year
If he is part of that company for an year, then he can get L1B and can apply for EAD for this wife within 6 months of I-94 dates.
But i'd suggest to try for L1A and get GC like an instant coffee at StarBucks.
Take a lawyer advise. The immigration lawyer in their company can do it. Or pay 350$ to sheela murthy and get a full advise.
Or there are lot of chaps in this firm who carry this knowledge like me.

The problem is you can't be an employee of your own company (while on H1B), not sure when you are on EAD status. It might be safe that you quit as CFO and then be an employee of that company. However to be on a safer side you consult a lawyer.

any sensitive strategy information. The best way to do this is to talk to your local state chapter leaders over phone or such. Many of you do not want to join the state chapters but want information on what IV is doing. :)
One of the main reasons to strengthen the state chapters was also to enable frequent passage of information/developments etc from the IV core to the chapters. This is what we do at the chapter meetup(s). Also developments change often that frequent updates cannot be given or become obsolete.
I have talked to the IV leadership and I am assured that they are working diligently behind the scenes on multiple possibilities. Success will be ours. :)

- Contribute monetarily. If you really want an online forum to track receipts/EAD/AP etc, go to . IV forums is not for receipt tracking.
- Be ready for IV action items which may need swift actions.

Hi all - We have entered into a contract for a home to be closed in May'09. Can we claim our 8000 tax credit ahead on our 2008 return (ahead of our closing date)? We have the address of the property. Its just the possession / closing will be after April 15. Thanks.

More than the airlines, I would suggest checking with your doctor if such a long journey is advisable esp in the last trimester. I doubt the doctor will agree to it. You might also need a medial certificate to travel.
Also airlines at their discretion can prevent you from boarding if they think you may have medical issues on the flight.
Why don't you ask your parents to come over instead ?
