Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.
I totally feel for you right now. A lot of people are celebrating the unexpected news, and those that have applied for labor possibly MUCH earlier are still stuck.
Let's hope that the BEC keep to their new revised deadline and the Visa Bulletins remain rosy for you

They can interpret the law how the language was used in the legislation as well as what congress intended to do. Any way, before 2000, INA clearly enforce the veritcal spill over in EB catagories. After year 2000 (after AC21 amendment to INA) INA was modified to horizontal spillover. DOS did not noticed this change till 2007. Only after 2007 (after AILA&congress efforts) DOS paid the attention to the law change and exactly following the law. Till that point EB3 was benefitted. One of the purpose of AC21 law is, to remove country quota in EB catagories. The intension is, becuse of 7% country limitation, american competiveness should not be affected (to eliminate the limitation of the high skilled immigrants from oversubscribed countries in higer catagory).
Can you post links to any official memo with regards to this change if you happen to find. This will clear the confusion. I do not think AC21 amendment changes anything specific to spill over visa allocation. Anyway.. I am trying to find the link to any official memo and will post if I find any

I may beat you on total wait time. it's 15 yrs since i entered this country (1995).
first labor filed 1999 (11 yrs back), current one started in 2004
Arae mere pyaara bhaai,
I am completing 10 years in GC process in September 22, 2010.
How about that?
Before the first application gets to process, I left the company and joined another company. The GC which I am waiting for since then was filed by the second company. They filed it on EB3 eventhough I was eligible for EB2 for "easier processing". At that time both EB2 and EB3 were current. And it remained the same way till I got my labor approved the very same month it went into retrogression. Since then I am waiting.
By the way, my first company sold the labor they filed for me for $15K dollars to another guy. He got his GC in 2005 and just 2 months back he became an US Citizen.
That is a long story told short....

The only and simple way to stop H1B abuse is to allow only max 10% non-immigrant (H1, L1, TN etc) employee in a company. Rest 90% have to be Green Card or Citizen. These desi consulting, Indian big companies must be hving at leaset 90 % employees on non-immigrant status.
Simple and universal rule that will solve all the H1B problems
This is a bad idea seeing how the green card process has open ended timelines. Unless something is done to guarantee green card issuance under a reasonable timeline, we are going to see increasing numbers of people waiting on H1 for a green card.

GCPerm, Saralayar, spicy_guy, freedom_fighter and others ........ dedicate your time (30 or 60 minutes everyday) on green card backlog issues. Help us all in this process.
Things are not as easy as it seems......Writing letters alone does not solve problems - and reading pappu's post - monthly trips to DC, meeting with (dont know who all), raising funds, having lobbyists -- all of these are things that take up time. IV has already said that it cannot take it on unless they achieve the primary goal of clearing backlogs.
Think about it, gcperm is the only guy who has met with Schumer's office. That's it. Even he has no idea on how many more senate offices he has to meet....... Or how deals are cut to get any legislation considered............. I read the Citizenship doc - nothing in it is viable - everything in it only shows the total lack of knowledge regarding laws.
US in never going to adopt point based system - for green card or citizenship. Every other recommendation past 4 relates to point based system - so chuck them out. As for recommending the form and the fee for it - and actually putting the price on it - again shows the lack of thought.
The third and most important one, you are asking for these benefits for employment based category - things never work that way. Every group of immigrants will ask the same benefits or if they cannot get it, they will fight tooth and nail so that no nobody else gets it too.
Congratulations for getting your green cards. Stay and help out the members who are yet to get their green cards. IV am sure would take on the issue of citizenship once it has achieved its primary goal.....
I agree. No point system. But how is asking for wait time after filing 485, counted against citizenship eligibility, not valid? Its perfectly valid and that eases the pain for MANY!

Thanks for your prompt reply! I think CP filers would be around 5%. Atleast in my organization, in July, 70 people filed 485 and I am the only CP applicant!
So you will be on H1 till conclusion. Best Luck.

After reading the post on this thread, I am sure I must have fumbled something. Please read and advice
1. My wife came here (USA) on H4 visa in Dec 2005, got 1 year.
2. Applied for H1b in May 2006
3. Applied for H4 visa renewal in June 2006
4. H1B got approved Sept 25th
5. H4 got approved Oct 21th 06
6. Applied for SSN Jan 1st 2007.
7. Since SSN#, she is working
Is there any gotcha or issues that we might have created in between?
Is it a good idea to get H1b stamped from Canada?

Congratulations. No more checking processing dates, I-94 or most importantly that visa bulletin shit that we so anxiously wait for. Enjoy the freedom.

EB3
MurthyDotCom
It is expected that the cutoff dates in the employment-based, third preference category (EB3) will remain the same during the month of May 2008. However, this depends on the USCIS's processing of cases, as visa numbers are assigned based on I-485 approvals. Therefore, the number of I-485 applications approved by the USCIS determines, to a large extent, the immigrant visa number usage. (The consulates also use EB3 visa numbers, but far fewer than the USCIS.)
MurthyDotCom
The EB3 cutoff dates moved forward in March and April 2008 in an attempt to avoid a recurrence of the events of the summer of 2007. As our regular readers, in the summer of 2007, the Visa Bulletin reflected current for most categories in an effort not to have an immigrant visa numbers go unused by the end of the fiscal year. They dates are being moved more quickly in the spring, as there is a potential that USCIS will have to reallocate staff from I-485 cases to naturalization cases to address the backlogs with those filings in order to naturalize eligible individuals prior to the November 2008 general election. Moving the dates forward permits case approvals and full utilization of immigrant visa numbers before the end of the fiscal year.
According to murthy's website, May VB will not move for EB3, bad news for us.

Just had a Q..if the last one in the list is a senator (Robert Menendez), should we ask him to support the house bills? no matter what, I already asked him to...
You got it. Sen Menendez is a key member. Even though there is NO companion bill in the senate right now, we need his support.
realizeit,
Please hold on to the member list on the 1st page. As I said, we do have a reason why we are going with that member list. We will move as we needed.
