Yes, as far as I know you will get only 3 months on OPT. For your OPT to reset your new degree has to higher than masters. With the new rules of 26 month OPT, MBA are not quialified, while MS(Engineering) are qualified. If not sure if you can use that to get 26-9, 17 months OPT.

For me the more pertinent questions in that time frame are:
1) Will there be a lame duck session, and do we have any chances of visa recapture in that.
2) Will there be any overflow from EB1 and EB2ROW to Eb2I as this will be the end of the 1st quarter.

You need not apply for EAD if not required, stay on your H1B. If you switch to EAD and your 485 is rejected for whatever reason (chances may be low but still) you�ll be out of status. EAD will be useful to your wife on H4 if se wants to work, for you there is no major advantage.

if possible I would apply for both EAD and H1 renewal. Its good to have a fallback if something happens to H1. I know what you are referring to, that you need to apply for EAD renewal sooner, But yes, you gotta do what you gotta do.

I think that may not work out in your favour. I have heard that "Consulate officer says, America has best medical facilities and your daughter/daughter-in-law will be well taken care of and you don't have to go for that reason" , has someone gone through this???

In visa bulletin they clearly stated that dates will retrogress for India and china for FY2008 i.e. starting oct 2007. I believe all who are current to come under shelter before they close the gates

You know, if there is one thing that I have learnt in the past 8 years of this immigration quagmire, then that's got to be to remain optimistic and give time to rule the roost.
For all our worries, lets for a second, play devil's advocate and say its going to happen. Consulting is banned, companies like Wipros, TCS's, Accenture and several others such as these including our own desi bro companies will get effected.
Flip side to that is to find citizen independent consultants or to send jobs out.
I for one believe that this will force America to bleed jobs. Bleed hightech jobs out of every nozzle they have. They can keep all the Agi jobs, lawn moving jobs they want but it cannot stop technological innovations wait while they are trying to fill people using citizen consultants.
Globalization will knock the wind out of America if they sit and pass stupid laws just because democrats and republicans want to fullfil their egos. If it has to happen, so be it. What goes up has to come down. America rode up because they had the knack to attract the best and the brightest, now, if they decide to kick them out, watch the elevator come down...
We all have walked into US and have our moderate success that we have in a foreign nation. Now if we are pushed to go back, I personally would take it as a challenge to better myself in my own nation. US is an awesome place, no doubts abt it, but laws like this will only express its growing ignorance as well as arrogance....

Somebody posted on another thread quoting USCIS customer service that they plan to process all I-140's from july/aug timeframe by early Feb 2008. I think we should verify that information and if correct, wait for a couple of months before starting this campaign.

Did your lawyer forget to attach the info of I 140 in I 485?
I think while filing I 485, you have to let USCIS know about the status on I 140. whether it is approved, or pending and the receipts and all that....
