Even if I do not support country quotas, it is a controversial bill even amongst IV members. Lets put all our energy behind HR5882. That bill has the best chance to pass if any.

Looks like it. As per cnn the congress should end the lame duck session by Thursday.
http://www.cnn.com/2006/POLITICS/12/06/congress.roundup.ap/index.html
But Republicans about to lose their thrones are doing nothing not sanctioned by Bush before the 109th Congress shuts down after a final, four-day work week. On Wednesday, the administration released a statement saying the president strongly supports the fetal pain bill, which would require women at 20 weeks of pregnancy and beyond to be informed that an abortion would cause the fetus pain.
I guess the congress will work until Friday as Monday (12/4) is not counted as part of the 4 - day week.

It's not just for finger print, its mainly for the photograph. As you go for the photograph they also take finger print (just right index finger) again for records. I have EAD renewal biometrics appointment end of this month but I went 15 days in advance and got that done.

Something was supposed to happen in Dec 2005. Then again in the fall of 2006. Now we push it to 2007.
Where is the end to all this?
It does seem like a sliding scale :( What I have heard is that BY 07/07, the CIR issue will be discussed for sure in both houses. Let's see what happens.

What about 'cc' to Emilio Gonzalez :D :D
I have seen too many posts that deride murthy firm and even AILA. Don't know what she did against IV to deserve this. I hope this is not due to IVs pride in itself. I know there are many bad lawyers, but never heard that murthy is a bad one. Her letters may not end up getting any results, but she is atleast trying to do something, unlike many other law firms.
Just my 2 cents.

I am planning to get stamping my H1 in US consulate Hyderabad. Wanted to check with anyone who has recently been there. My first question is
1) There is a question " Is your visa expired in past 12 months"? Can some one please tell me what this means? My last stamped visa expired in Feb 2009 so should I say Yes? But I have my approved I-797 petition valid till 2012. Can some one please share their experience on this question
2) Can some one please provide a list of documents to carry?

This is the height of being scared.
Some people create annonymous profiles because they are scared USCIS will come after them if they post anything on the web. I have known people who are so scared when their name shows up in google search and think they will be stuck in FBI namechecks. Now some people are so scared they ask their own questions by saying' they are asking for their friend'.
Ask your friend to come on the site himself and post. We wiill answer questions that are yours only.
Come on 'high skilled ' 'best and the brightest' grow up.
I don't think people should answer 3 kinds of posters:
People who ask questions for their friend.
People who create thread without proper title
People who post offenive messages
Well said.

You would have understood by now that many posters here think that "your friend" is actually "you". If that is the case, learn to face problems bravely. There is nothing wrong in admitting to a problem or failure. There is no shame in it. If you are in fact posting for a friend, ask him/her to login and ask here openly.

What were you doing till Feb 25 ? I was in same situtation , I went to CBP in Chicago they did not change my I94 so I travelled to Canada and while returning I asked for a new I94 and they did change my I94 till the validity of Visa .
Your situtation is more complex as you I94 is already expired , that means you are out of status .

If you plan to mail the documents, be careful to read the instructions. I just applied my passport to Houston CGI and misread the instructions saying it would take 10 days. It takes 10 days if you got your passport from the local Indian consulate in US but if it was issued by Regional Passport Office in India, it would take six weeks.
They have something similar to Tatkal where you can pay 90 dollars and get it faster. How faster, don't know.
Once you have submitted your application, you are at their mercy and Houston seems to be worse than Indian regional passport offices. Their phones are constantly engaged and they barely respect you when one calls them. You have no way to upgrade.
If you have the time and proximal to an Indian Consulate, I would try going in personally and get the work done.
Thanks a lot to everyone for taking time to respond to my query.
I'm planning to appear personally at New York Indian embassy to clarify if they have any questions because the current passport was applied thro Tatkal service and I see a note (OBSERVATION: The validity of this passport should not be extended without prior reference to the office of issue) in the passport.
Would this cause any delay in issuing my passport ?
Thanks

Question? Did you send a combined check for all the amounts together with one check? (325+170+180+70) 745? If you did, I guess as per the filing instructions on each application, they require applicants to cut seperate check for each application. could you please confirm with an attorney.
My lawyer also made me send combined money orders. He insisted on postal money orders.

I have also same question. Any input would be greatly appreciated.
A substantial salary difference can result in denial
However this is not the only factor and it really is upto the Officer reviewing your case
Please see the extract from the recent USCIS Q & A about same or similar jobs
USCIS - Questions about Same or Similar Occupational Classifications Under the American Competitiveness in the Twenty-first Century Act of 2000 (AC21) (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=1efbac8ec3d2f210VgnVCM100000082ca60aRCR D&vgnextchannel=6abe6d26d17df110VgnVCM1000004718190a RCRD)
Q4. The December 27, 2005 AC21 Memo states that a discrepancy between the wages of two jobs may be used to decide if the two positions are the same or similar, but the memo also states that a difference in the wages of the two jobs cannot be used as the sole basis for denial in adjustment of status portability cases. Can USCIS provide further explanation on how wages are used to determine whether two jobs are in the same or similar occupational classification?
A4. Section I, Question 3 from the December 27, 2005 AC21 Memo provides USCIS officers with the flexibility to consider a substantial discrepancy in the wages offered in two positions to assist them in deciding if the two jobs are in the same or a similar occupational classification. A substantial discrepancy in the wages of the two jobs may be a contributing factor in a denial when the evidence is considered in its totality. However, a USCIS officer should not deny a case solely because a second position pays more or less than the original.
Section 1, Question 5 from the December 27, 2005 AC21 Memo references a difference in the wages to inform both USCIS officers and the public that a difference in wages should not be used as the sole basis for a denial. This means there can be an allowance for normal raises that occur through the passage of time to account for inflation and other factors such as higher rates of pay in different metropolitan locations.

Hi Chicago Desi,
When you think they will file your EB2 PERM? Are they done with advertisements etc?
I am in a similar situation. Sad things is, my employer's lawyer is also clueless on this. After the first f'ck up (filing EB3 instead of EB2), they are off to second one now in 2 months (refiling PERM in EB2). My i140 is approved based on the previously approved EB3 PERM. Lets see what happens.

As per my knowledge(?) an extension beyond 6 years is possible ONLY if one of the following is true:
1. You already are on (beyond 6 years) extension then you are eligible for further extension.
2. Your labor IS pending for more than 365 days. (What if the labor is currently approved but was pending for > 365 days before it got approved!)
3. Your I-140 is approved, which will enable you for a 3-year extension.
So anybody, who has an approved PERM labor but not an approved I-140 cannot get an extension beyond 6 years.
Other experts please weigh in.
Thanks
I think he is right. Did you happen to talk to attorney? Just curious what qualified advice is for this situation...

Gurus,
I left my GC sponsoring company this week for better opportunity. They sent me a letter stating that, they are going to notify USCIS about my resignation.
Here are my questions:
1) Should I file AC21 before they (GC sponsoring company) notify USCIS?
2) What will happen to my I-485 application once they notify USCIS about my resignation?
Thanks for your help and time!
1. It does not matter whether you file AC21 before or after your employer notifies USCIS. Since you are already working with a new employer, go ahead and file AC21 before your old employer notifies them.
2 USCIS can send an RFE/NOID on your I-485 asking for proof of full-time permanent employment in same/similar occupation.

I have to know one thing...Should we always be on a insurance for continuity, which in the long run could reduce the premium? Or is it "when I have insurance I have it"??
