    My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

    WASHINGTON (AP) -- Like twin Jacques Cousteaus of the political world, President Bush and Congress are probing the depths of public opinion polling as voters exasperated over Iraq, immigration and other issues give them strikingly low grades.

    In a remarkable span, the approval that people voice for the job Bush is doing has sunk to record lows for his presidency in the AP-Ipsos and other polls in recent weeks, dipping within sight of President Nixon's levels during Watergate. Ominously for Republicans hoping to hold the White House and recapture Congress next year, Bush's support has plunged among core GOP groups like evangelicals, and pivotal independent swing voters.

    Congress is doing about the same. Like Bush, lawmakers are winning approval by roughly three in 10. Such levels are significantly low for a president, and poor but less unusual for Congress.

    "The big thing would be the war," said independent Richard MacDonald, 56, a retired printer from Redding, Calif. "I don't think he knew what he got into when he got into it." As for Congress, MacDonald said, "It's just the same old same old with me. A lot of promises they don't keep."

    Bush was risking more unpopularity by commuting I. Lewis "Scooter" Libby's prison term in the CIA leak case, and his refusal to rule out a full pardon. Polls in March after the former White House aide's conviction showed two in three opposed to a pardon.

    The public's dissatisfaction may be more serious for Republicans because even though Bush cannot run again, he is the face of the GOP. He will remain that until his party picks its 2008 presidential nominee - and through the campaign if Democrats can keep him front and center.

    "Everything about this race will be about George Bush and the mess he left," Rep. Rahm Emanuel, D-Ill., a member of the House Democratic leadership, said about 2008. "He'll be on the ballot."

    Congress' numbers could signal danger for majority Democrats, since they echo the low ratings just before the GOP 1994 takeover of the House and Senate, and the Democratic capture of both chambers last November.

    But unlike the president, Congress usually has low approval ratings no matter which party is in control, and poor poll numbers have not always meant the majority party suffered on Election Day. Voters usually show more disdain for Congress as an institution than for their own representative - whom they pick.

    A majority in a CNN-Opinion Research Corp. survey in late June said Democratic control of Congress was good for the country. Yet only 42 percent approved of what Democratic leaders have done this year - when Democrats failed to force Bush to change policy on Iraq.

    Republican strategists hope the dim mood will help the GOP in congressional elections.

    "The voters voted for change and they expected change, and they see an institution still incapable of getting anything done," said GOP pollster Linda DiVall.

    The abysmal numbers are already affecting how Bush and Congress are governing and candidates' positioning for 2008.

    Last Thursday's Senate collapse of Bush's immigration bill showed anew how lawmakers feel free to ignore his agenda. Republican senators like Richard Lugar of Indiana and George Voinovich of Ohio have joined increasingly bipartisan calls for an Iraq troop withdrawal.

    This year's GOP presidential debates have seen former New York mayor Rudy Giuliani, Arizona Sen. John McCain and others criticize Bush or his administration for mishandling the war and other issues. Some Republican congressional candidates have not hesitated to distance themselves from Bush.

    "President Bush is my friend, and I don't always agree with my friends," said Sen. Gordon Smith, R-Ore., facing a tough re-election fight next year. "And on the issues of Iraq and immigration, I simply disagree with his approach."

    Bush's doleful numbers speak for themselves.

    In an early June AP-Ipsos poll, 32 percent approved of his work, tying his low in that survey. Other June polls in which he set or tied his personal worst included 27 percent by CBS News, 31 percent by Fox News-Opinion Dynamics, 32 percent by CNN-Opinion Research Corp. and 26 percent by Newsweek.

    The Gallup poll's lowest presidential approval rating was President Truman's 23 percent in 1951 and 1952 during the Korean war, compared with Nixon's 24 percent days before he resigned in August 1974. Bush notched the best ever, 90 percent days after the terrorist attacks of Sept. 11, 2001.

    The AP's June survey showed that compared with an AP exit poll of voters in November 2004, Bush's approval was down among swing voters. His support dropped from about half of independents to a fifth; from half to a third of Catholics; and from nearly half to a fifth of moderates.

    Among usually loyal GOP voters, his approval was down from about eight in 10 to roughly half of both conservatives and white evangelicals.

    Congress had a 35 percent approval rating in a May AP-Ipsos survey. Polls in June found 27 percent approval by CBS News, 25 percent by Newsweek and 24 percent by Gallup-USA Today.

    Congress' all-time Gallup low was 18 percent during a 1992 scandal over House post office transactions; its high was 84 percent just after Sept. 11.

    In the AP poll, lawmakers won approval from only about three in 10 midwesterners, independents and married people with children - pivotal groups both parties court aggressively.

    just finished going thro all the proposed ammendments...only a handful (1154, 1156, 1166, 1183, 1200, 1220, 1242, 1249) deal with EB issues at all....very few of them are positive (3) for us.........also based on an article on immigration-law website, EB based people have no voice in the negotiations!!! so...as frusterating this may be.....its looking like a certainity that many of us will be screwed big time..........lets keep doing what we can through IV.......it looks all dooms though.........:mad:

    Hi,

    Recently we moved. So I did not apply the AP renewal(a two month window) till we move. But now my wife has extreme family accident/emergency in India. So we applied for AP online and went to Chicago field office (we went there because kid also need INDIA VISA STAMP) and to Milwaukee office with letter from document. They said that they would not approve. So I have sent the support document s for I-131 to the Texas Service center in overnight courier service today. I have H1 valid till may 2010. What are my options?

    Does her travelling on H1 with AP pending will cause problems to I-485?

    If the new bill gets approved when will it likely take affect? I just had my LC approved today and they are going to file I-140. Before the EB-3 retrogression for all nationalities i was told i-140 an i-485 could be filed at the same time. what impact does the new bill have on my situation?

    For the second time this month, a local South Carolina Republican Party committee is expected to decide soon whether to formally scold Sen. Lindsey Graham (R-S.C.) for supporting the Senate's now-stalled immigration overhaul proposal, putting the once-popular lawmaker on the defensive and upping the ante for a potential 2008 primary challenger.

    "The frustration [with Graham] is real," said one state Republican source, who added that the state's large conservative base is "just searching for someone" to challenge Graham in next year's primary.

    The Spartanburg County Republican Party is expected to vote Aug. 23 on a resolution officially rebuking Graham for supporting his chamber's immigration bill. Criticism of the reform package, which was shelved last month after failing to gather the 60 votes necessary to cut off debate in the Senate, has raged throughout the country and particularly in states such as South Carolina, where AM talk-radio hosts have bloodied the Senate proposal and said it tries to reward those who have broken the law.

    Rick Beltram, chairman of the Spartanburg County Republican Party, said he doubts a resolution criticizing Graham's stance on immigration would pass by a wide margin. But should the measure come up for a vote, Beltram already has developed a game plan to manage what likely will be an angry lot.

    "This being as explosive as it is, we would ask for a secret ballot so 30 or 40 Rep. Ron Paul [R-Texas] people yelling in the background wouldn't have an influence on the election," Beltram said.

    Last week, the Greenville County Republican Party passed a resolution censuring Graham for continuing to "adamantly support legalization of illegal immigrants." In addition to immigration, local party officials reprimanded Graham for supporting campaign finance reform and participating two years ago in the "Gang of 14," a bipartisan Senate group that negotiated a compromise on controversial federal judicial nominations.

    The resolution also criticized Graham's recent statements before the National Council of La Raza, which were captured by cable news networks.

    "We are not going to run people down. We are not going to scapegoat people. We are going to tell the bigots to shut up and we're going to get this right," Graham told the crowd.

    Samuel Harms, the Greenville GOP chairman whose group adopted a resolution in 2001 "opposing any legalization of illegal immigration," said Graham's speech to La Raza was the "straw that broke the camel's back." He added that the resolution was "about informing people that Lindsey Graham called the good people of Greenville bigots and that we need to be told to shut up."

    A successful censure vote next week in Spartanburg may signal a widening opportunity for a potential Graham challenger next year. So far, Graham faces only token primary opposition and last month he dodged a potential bullet when popular state Treasurer Thomas Ravenel (R), who was considering a run, was arrested for allegedly distributing cocaine.

    Democrats have yet to find a challenger to the first-term Senator.

    After recapturing some of the love lost during his Gang of 14 days, a GOP source said Graham's recent bruising for supporting the immigration bill may convince some conservative party activists that an opportunity is again at hand. Also, Graham's support of tanking presidential candidate Sen. John McCain's (R-Ariz.) campaign, the source said, is not helping his cause.

    "The immigration issue reignited the ember," the source said.

    Still, with Graham sitting on $4 million in the bank, potential primary challengers face a steep uphill battle contending with an incumbent who may have twice that total squirrelled away before the year's end. Lt. Gov. Andr� Bauer (R), frequently said to be mulling a run, told Roll Call last week that he has not ruled out the possibility of challenging Graham.

    "I would never say never," Bauer said. "But I don't have any plans to run against him."

    But Bauer does plan to appear at the Aug. 23 meeting of the Spartanburg County GOP.

    Katon Dawson, chairman of the South Carolina Republican Party, said that while it's unusual for party activists to go to such extremes with federal officeholders, the immigration issue has struck a nerve with the party's base.

    "You can't bluff it, you can't beat around the bush about it, it's there and it's real," he said. "Lindsey has a different philosophy on immigration and there's no question it's hurting him."

    For now, Graham appears to be resting on his conservative laurels and betting that the controversy will pass. Graham currently is out of the country, his campaign said Friday, but will return to the state to campaign later this month.

    "Lindsey Graham is a strong conservative voice in the U.S. Senate with a lifetime conservative rating of 91," according to a statement provided by spokesman Scott Farmer. "He will seek re-election based on his conservative voting record and willingness to tackle the hard problems facing our nation."

    Whit Ayers, a Republican pollster, said immigration undoubtedly is a challenging issue, but one that plays to Graham's strengths. Even more, despite the current controversy, Ayers said voters ultimately respect lawmakers who take principled positions.

    "Sen. Graham is a remarkedly adept politician who will be able to be very persuasive about the reasons why he's done the things he's done," Ayers said. "I don't think we would expect our politicians to be in lock step on every single issue that comes up."

    He added: "There's no question that Lindsey Graham is right where most Republican voters in South Carolina are on God, guns, gays and taxes."

    I've a situation here to switch from Company A (who sponsors my GC and H1B) to Company B, I've completed AOS (6 months period too):

    1. Whether I can transfer my H1B (sponsored by company A) to company B when i join them? (but H1B is not stamped yet on PP) if not H1 transferrable, then I've to use EAD only.
    2. Company B will ask me what papers I need for GC sponsorship either NOW or in FUTURE, can anybody know this? please help
    3. I know that i need to file AC-21 to do the switch, what are the procedures like:
    a. job position should be same or similar?
    b. what paper work other than AC-21 needed to do this switch in changing employer information, fees for doing this change?

    any help/advice would be greatly appreciated. Please let me know.
