I was in a similar situtaion. The BC I got had some nick name which my dad told at the time and is off by 10 days. My attorney told to give that cert and an affidavit from parents that this indeed is the matter. I have not really filed for I485 though. Still waiting for my dates to be current.

I applied for I485 about a month ago with all the papers that were asked for ,but i got a letter saying "Request for initial evidence I-485)"
F. (40) The sponsor or joint sponsor on form I-864 affidavit of support must submit the following:
. W-2s,1099s,and /or all schedules submitted to the IRS-a copy of his/her Federal Income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return.
What does that mean?As far as I know I already submitted all the above mentioned.I called USCIS and as usual the person on the phone didnt know anything and told us to submit it again.Will that be of any good? Please help me.I have been called for biometrics this weekend.Will it be of any use if I ask them what to do?

Form I-864 is needed only in the following cases
1) All immediate relatives of US citizens.
2) All Family based cases
3) Employement based cases only when a US citizen or LPR relative filed the
immigrant visa petition or such a relative has a significant ownership interst
in the entity that filed the petition.
So in short all EB cases dont require I 864 infact you employement letter is the one which proves that you can support yourself. Only in cases where the
employer is relative of the applicant or when the company that is sponsoring the applicant has a relative which owns more than 5 percent ownership interest has to fill out this form. For eg your uncle owns a desi consulting firm or is a partner in the firm that sponsors your LPR then in that case you have fill out 864 form.

My previous company is refusing to give me a official experience letter..even though i worked there for three years..
I am ready to file for my 140 and my attorney initially said that two Notarized affidavits from employees at the firm who worked with me will be good enough..
now he is saying he is not sure if USCIS will accept those affidavits...
has anyone used such affidavits to prove their experience.?did it work
Will USCIS reject 140 because of this or will they issue an RFE...
can i send the h1 approval that i had with that company as a proof of working.

So it may not work, for some people it has worked. If you get an RFE, USCIS will give you max 45 days to produce a letter and trust me its a very short time to get the letter from an uncooperative employer. Nor is confrontation going to help as there is NO law that requires your employer to provide one such letter. Hence, I would say use all your network and contacts and every trick possible to get the letter.

2nd time before interview I called senator's office and explained his assitant that my Mom's purpose of visit is tourism and she has enough property and family ties that she won't stay over here. Also I am going to take care of her all financial needs. After our discussion she agreed to give me a letter and send same later to Bombay Consulate explaining all details based on our discussion and requesting officer to do needful. 2nd interviews was pretty simple… couple of question (very simple question) and before even she completes her 2nd anwser officer congratualted her!!!!!!...

Thanks for the information Ram. The only reason I am hesitating to apply for parole every year is due to the rule that one must be in USA until it gets approved. So, if it doesnt get approved before her vacation then it will be a problem.

Friends,
I would like to get your advice on options I have. Here is the situation. My Passport was expiring on 25th Feb 2008 when I entered USA last year. My I-94 was stamped till Passport expiration. I have valid visa till Dec 09. I got a new passport from Chicago. My company has applied for I94 extension (even though I had valid Petition and visa) in Jan 08. I got a query on my application.
My Valid visa is on my expired passport
1) Is it safe to go to nearest CBP now and take a chance if they can extend my I94..will there be any complication in it?
2) Can I apply for Canadian Visa go out of USA and re-enter..will I get new I-94? What will happen to my I-94 application which has already been applied and there is a pending query?
3) Shall I go to Indian and come back?
