    I've also had plenty of LUDS since 140 approval on both 140 and 485 but the last one (b4yesterday) was on Dec -2007. Just find it curious that they touched it yesterday, the day b4 rumours of my PD become current are abound... ;-)

    Alhamdulillah, by Gods grace i and my spouse got the approval email yesterday.

    This site was really helpful and i wanted to thank Pappu and Raju for their help. I don't know if you guys remember, i spoke to both of you during august 2006 and got some valuable help from you guys.

    Guys,

    I would really appreciate your help here:

    How many days before the start date on the H-1B approval notice can one go to the US embassy to get the H-1B visa?

    The new H-1B approval has a start date of Nov 1, 2008. Can one go on say Oct 15, and enter the US with a new visa before Nov 1st?

    Current status is H-1B, expiring on Oct 31, 2008.

    Different consulate have different rules of how early one can apply for an approved h1b petition but from what I know and understand he can go before OCT 31 and get a stamp for the start date of Nov 1. He can go as early as 15 day i.e. OCT 15 /16

    Moorthy.com has drafted a petition to send to the law makers to increase the H1B cap! I don't remember they have done anything to help us in the Green Card process, apart from charging hefty fees for filing the papers!

    It makes business sense for them, if all the H1 holders get their GC in 6 months where will they make money by filing for renewal and extension. Yes, they need more H1B!

    SO I think we must take it as just "may" and not "must". So the beneficiary can pay some part as it looks like., legally.

    Same with my attorney. They will charge me only once for filing 485. I can either chose to do it now or hold off and do it later if/when my turn comes up. I have decided to go ahead and file it now and get rejected just so that I become a part of the "class" if the law suit becomes a reality.

    Favorable result from AILF law suit is expected to release limited visa numbers which will be used to accept applications as first come first serve basis.
    These numbers might not be even sufficient for July 2'nd filers.

    I agree. Thatz what I am doing, having my employer HR work through my lawyer. I have no other choice than trusting them as of now.

    It purely seems like USCIS error, I dont know how many more are affected like me.

    Friends,

    This is not immigration related, however I am facing a strange confusion. HOpe someone out there may be able to guide me.

    I received a check in mail yesterday. Surprisingly there is only a check, no other paper or information inside the envelop.

    The envelop & the check itself looks like from US dept of tresurey, however I am not expecting any at this point of time (atleast I don't remember). I have never ever stayed, worked in fresno. I am not in CA either.

    first I thought of tax refund, however I did e-file and it is directly settled with my bank account. Then I thought of stimulus, but that is also not the case as last year I did receive stimulus check, and also there was a letter explaining about the check. So What else it could be? There is no phone number, address given where can I call and ask. I searched google, some ppl received similar check but have no idea from where it came. (found on yahoo answers (http://answers.yahoo.com/question/index?qid=20080617081119AAghyk7)when searched for 'fresno tax refund'. Also found posted on other forums but no definite answer found yet)

    Can this be a possible scam? On envelop it is written that this is from philadelphia, inside on check its written as fresno tax refund and I can also see word 'Austin' written. I am confused. I am not sure if it is genuine or fake. I know there is no free lunch, and hence I am scared if this is a case of id theft or some other scam. If it is not genuine, I would certainly like to report this to authority. However first I thought I ask more information if anyone else has also received this kind of mail.

    Is there anyone who also received similar check or have any idea? If yes, please share. Help me figure out ...

I mean, if say some of us are affected by this but AILA has enough representation, does everyone who was eligible to apply in July become a part of the lawsuit?     Thanks for the replies. Feels encouraging. So on/after Feb 1 the new company will apply for H1 transfer and I can start working with them as soon as they get the receipt?

    You start working for your new employer after you receive the copy of H1B transfer receipt.

    Also, I dont have any copies of the I140 or I485. Will the new company need any of these when they do the transfer? How will they know what my priority date was? All I have are receipt numbers for my 485/131/765 etc. And I know my 140 was approved. I just dont have any receipt num for that.

    Try to collect the below documents from your current employer;

    1. LCA Form 750 (pre-perm) or 9089 (perm) & approval page
    2. 140 Approval Notice
    3. Employment Verification Letter that was initially submitted with your 485 - at least a content.
    4. You should have the copy of 485 form w/ you - as employer can not submit with out your signature.
    5. 485 Receipt Notice

    I have heard from a couple of folks that they have met some senior senetors like Bob Dole and have influnced INS to speed up their case of GC processing. Is this true ? .
    If this is true is there a way to stop the influence by senetors so that these everyone gets a fair chance of getting their GC.

    In 2004 I retained the services of an International Tax Accountant to file my tax returns and per his advice, immigration attorney fees are not a tax deductible item. However, paying an accountant to prepare your returns are tax deductibe the following year.

    Let me also add, that in the US we are expected to pay taxes on our world wide income. There is of course a dollar for dollar tax credit and then we must pay taxes on the portion that is underpaid compared to US tax rates or pay taxes on items which are not taxable in your home country but considered taxed under US law. See, this is why I retained the services of an International Tax Accountant.

Having 4 offers in this slow job market means either you are in a field like Health care which is not much affected by the current economic situations in the country OR you are exceptionally talented.     Another Bump,
    After paying Lawyer fees and sending him EVL, My Lawyer told me that Job is same or similar to Labour Certificate. but since you salary is double than Labour salary , it can create problem. GC can be denied. I used the same EVL as AC21, just date was changed.

    I just want to know are there any case where GC can be rejected because of more salary. If this is the case what are my option, one of the option my lawyer told me to take Demotion in the current company where salary somewhere near to the Labour labour salary. Please suggest as I am very much worrried now.

    We will have lesser pain If we think as if we are living in some middle east country where no immigrant gets citizenship I believe ...they just keep issuing visa after every two years.

    Thinking they will do something in favor of legal immigrants seems almost impossible in this economic situation. That too when they are not letting pass healthcare bill which possibly could be beneficial for Americans.

    I have less pain now when I think I am in mid east with more freedom...I have to keep renewing EAD & any moment of time I could be denied and go back to own country..

    GC wait is endless ...at least for EB3

    Actually yes. When it comes to Tax, they tax H1Bs as Citizens/Perm residents but get no benefits because H1B are not Citizens/Perm residents.
    They are having it both ways. Some countries have different tax rates one from citizens while lesser for foreign workers/non residents.
