So you think ROW EB3 is also having honeymoon. How could you make statements like that. ROW EB3 was unavailable for 3 months while EB2 India enjoyed PD in 2006 and you think there is no problem with ROW.
Statements like these has the potential to make IV an Indian organization which only represents interest of Indian people and I don't believe that was the IV mission when it was founded. Please refrain from making statements like these.

What is the process of adding my spouse name in my pending I-485(Follow to join). She is not here and will wait in India till my PD comes current.
What document I need for the process.

The only option i see right now is for you to move back to H1-B and get her to US on H4. Filing a I-485 can be done only if your PD becomes current. You might try porting your EB3 to EB2, then you may be able to file I-485 for sooner.
If she can get a job on her own in US and be on her own H1, that's an option too.
Please advise me on this issue.

My lawyer suggested the same thing & have indicated that they ll not charge twice if the app has to be submitted again. They are concerned about the suit, and want to ensure that if a class action follows, we are eligible as members of the class to the extent they can define it now.

FYI - what is the PD on your approval notice of I-140. The reason why I am saying that they also had my PD incorrectly on my approval notice of my I-140. I just got it changed three weeks back. This is serious - sometimes USCIS assigns the ND/RD as the PD which is an issue. Hust double check it

I have a question regarding Pending AOS status and Expiring I-94 and whether this is an issue. Last time when I entered USA using Advance parole, my I-94 was stamped with a validity of one year (which I think is normal) but now its expiring and my I-485 is still pending. I am working on EAD and I am EB3 ROW (priority date not current). Can anyone provide some details on whether expired I-94 will be an issue during pending AOS? Normally, I-94 determine the status but I am not sure while in pending AOS. I read lots of thread saying expiring I-94 is not an issue but have not seen any official note from USCIS or DOL saying so. My lawyer said this is gray area.

Try to talk with some academic evaluators. You have to ask them whether your academic qualifications are equivalent to 4 year degree. So while faxing or mailing them, put a cover letter stating what you need. In some cases, they can prove that it is equivalent. There are many academic evaluators, one I heard about is Trustforte.
Specifically ask them not to consider your work experience while evaluating.

Hello Every one,
I am in a very complex situation, I will try my best to describe it. I worked for company A which applied for my H1B visa which got approved, in June'10 I moved to another company B as the job prospects are good. My Ex-employer A was not happy with that, he did not agree for VISA transfer. So my current employer B applied for another H1B petition which is under review now.
As I have a valid H1B applied by company A, my school terminated my F1 (OPT)status from this Oct 1st, which would otherwise get expired in March 2011. My Ex- employer(A) said that he filed for withdrawal of my H1B a week ago. I informed this to my current employer(B) and they have requested premium processing. I am worried what my status would be now, because I am no longer in F1 visa and my H1B is with another company for which I am not working anymore. Am I out of status?
Please let me know your suggestions/opinons. Thanks a lot for your time.

Reason can be simple as "i want to travel and see US More" to any medical condition or social reason.
Once you file the application , INS will take own sweet time for approval , so probably you will buy another 4 to 5 months anyway and i dont think we need more than that.

Did you get your denial papers, there is a date mentioned in the denial papers, you will have to respond within that date to appeal your case with supporting documents if the case is denied in ERROR (they give reasons in denial letter). If you don't respond the case is denied forever.
Also remember one thing you can't have two PERM applications open for the same company, same position and ofcourse same person. I had to withdraw my appeal to file a new PERM. some people here seem to be lucky to get perm in 2 months but for me it always took around 10 to 11 months. I lost 10 months in appeal and 2 months for withdrawal. so better decide what you would like to do.
Other option, which i am not sure is legal (or valid) would be to appeal the case and when the case status changes to pending file for H1b extension. In the mean time look if some consulting company can file PERM for you externally, if you get that PERM approved you can transfer your H1b... I mean it is easier for us to advice.. and i totally understand what you must be going through.. I was just thinking what options are open.

our(Me and my spouse)485 had hard LUD today with the message "Case Transfered to Another Office for Processing"
I seriously hope that it is not a delay tactic. I applied for adjustment of status in Aug 2007 but my case got transferred to NSC in Oct, guess what, my RD has got reset to Oct from August. The service centres process cases in the order they receive it and now I have to wait for NSC processing dates to move to Oct. My processing has got delayed for no fault of mine though my PD is EB2 early 2004.

Thanks a lot. Second part of my question - If you do not need to report accounts below $10k to IRS, then does that mean you do not also have to pay taxes on that? In other words, do you need to pay taxes only if it exceeds $10k?
Submit your own calculation of interest in a year (Jan to Dec). In India, anyway for tax purpose the interest info is from Apr to Mar.
I think, IRS trusts that calculation, never asked for supporting documents.
