    I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.

    I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

    Let us differentiate ourselves. Legal immigrants include people who come here on family based PR petitions. We are Highly skilled legal Immigrants.


    IMHO, WE SHOUD USE "WE ARE HIGHLY SKILLED LEGAL IMMIGRANTS" INSTEAD OF "LEGAL IMMIGRANTS". Going by what is happening in the hill and elsewhere, this distinction will work favorably for us.


    PAPPU, others, comment. Let us all be consistent.

    Guys if the employer's lawyer is not giving you information regarding the I140 and you are going behind their back for this information is it really going to help you with portability? It looks like they are just trying to make life miserable for you and what guarantee is there that they will not revoke your I140? I140 portability does not work if they revoke your I 140.

    My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
    Any body in the same boat? What shall I do?


    Try the TRENTON office. They are pretty cool. It may work there.

    Will it really create ablity to pay issue when an employer keeps many I140s without pay and create a problem for future Gc processing? If that is really an issue then cancelling I140 is not retaliation. People can post their views.

    You have used AC21 after 180 days then what is there to worry? Even if you receive RFE you can reply and you can get GC.

    Looks like "yes", especially if a companyh is sponsering too many GCs for people who are not on the payroll - they have to prove they have enough funds to pay the future employees.
    It is the desi Attorneys who give suggestions to Desi employers to withdraw 140 to avoid ability to pay issues.

    My question involves employment and labor law for the state of: CA

    I have worked with a company on h1b from 1st jul to 12 nov in 2007 on h1b visa. They did not pay me for last 45 working days. My employer is telling about the following clause in in my offer letter:


    SALARY: You will be paid an amount equal to a 70% basis of your bill rate based on the understanding that you will work with us for a period of at least one year. If you leave Company before completing 1 year of employment your compensation will be adjusted to a $55,000 per year basis and the excess amount paid to you will be deducted from the last two months of your salary.

    Please let me know whether this is legal to have this kinda clause in offer letter. Is there any way to get my salary?

    What is your salary on H1 LCA? Is it 55,000 year?

    If you're paid > LCA Salary, then probably nothing much can be done.

    When does the "Approval notice sent" status appear, it is about 7 days since I got the production ordered.

    ok, so you got card prodcution ordered. then after 7 days, it changed to "notice sent". then, card came in mail. Is that what happened to you, gcseeker?

    AC 21 like no changing of the jobs when 485 pending for more than 6 months....

    Bad for consulting companies (no H1B; may lose job)

    Bad for physicians (no H1B for medical residents; no provisions for NIW...terrible)

    Bad for H1b transfers and extensions (severe restrictive provisions on H1B)

    AC 21 repealed (disastrous)


    Bad for pending I 140 .... left in limbo

    Bad for pending LC .... left in complete limbo


    Bad for retrogressed.... backlog will increase phenomenally 'cos of decreased visa numbers

    This bill is a massive attack on us; we should put all our efforts to oppose and kill the bill. There is little chance that we can get amendments to reverse the potential damage that this bill can do... that is disaster for us.

    Go to the Trenton DMV . Take your ORIGINAL receipt and a letter from your employer . They will give you extension for 240 days . I got it done in May 2007.The draft of the employer's letter is as follows

    The Motor Vehicle Commission


    I hereby certify that ________________ is currently employed by ____________ and has been employed since ______________.

    I certify that, on ______________, I filed an H1B petition extension and application for extension of stay on behalf of this individual (see attached receipt notice from the US Citizenship and Immigration Services (USCIS)).

    Pursuant to 8 CFR 274a.12(b)(20), this individual is authorized to continue employment with ____________ for a period not to exceed 240 days beginning on the date of the expiration of the authorized period of stay (as indicated on the immigration documentation).

    Hindus could be anywhere in the world, not just India. Being a Hindu does not automatically mean you are an Indian. You could be a citizen of any country. So it does not establish the notion that it is an India centric website.
    Just like all Muslims are not from Saudi Arabia. They are in 100's of different countres and citizens of diverse nations from UK and Malaysia to Australia and Germany. Christians could be from Europe, Australia and India or the African continent or China and other parts of Asia. I personally know Hindus that are from Fiji, Trinidad, Singapore, Malaysia, Sweden, UK, Canada and they are not Indian citizens.
    Moreover, Diwali is for everybody, Just like X'MAS is. You can be an American and be a Hindu. So There is no question of IV getting targetted as India-centric or Indian issues-specific website.

    I just got off the call from uscis regarding my I-485. My PD is in the first week of Mar 2006.

    Per the USCIS website, they are suppose to process even the first week of Mar 2006 although the Aug VB says it is 01MAR06. I spoke to the second level IO and he was confident that my case would have to wait for the next month. I insisted that the uscis website says otherways, he went and verified with the third level (or his peer) and came back and told me that I was correct.
    Infact told me that my case was pre-adjd and being reviewed by IO currently.

    I am sure the same applies to you with the Sep VB. Good luck !!!

    Cool...This gives me some hope that my PD of May 8th will also be considered current from Sep 1.
