For people who don't know, Country Cap goes by Country of Birth , not country of citizenship...So if you are born in India but now you are canadian Citizen, you will still be counted as Indian for EB based Green Card allocation, isn't this a blatent racist agenda. I have a letter from Congresswoman Zoe Logfren's office, which clearly says 'I will work on removing arbitrary country quota on employement based Green Cards', we just need to pursue her...

The amendment offered by Senator Sanders requires employers to certify that they have not and will not lay off a large number of employees before they are allowed to employ foreign workers. I strongly believe that priority should be given to American workers. However sometimes there are no available American citizens to fill key high-tech or high-skilled jobs. It is important for us to make sure that American citizens are being considered first to fill these roles and that employers are not hiring foreign nationals while laying off our own citizens.

religion was the vehicle invented to mobilize people into groups, sects, splinters, what have you. religion divides us and makes us all weak.

Would you be offended if your parents picture is put on a toilet paper?
Afterall they are just your body's parents, and you use toilet paper for your body. But God is the supreme parent of everyone.
Do not just pass comments on Gods of any religion just because you do not have the ability to respect other's faith and feelings.
A lot of you will go and thank God once you get your greencard or blame God if your dates do not get current. But you do not fail to make a mockery of religion or other's faith. Be a good human being first before you claim to be best and the brightest or highly skilled person.

The regular quota for EB2 and EB3 combined is only about 9,800. That means 17,700 visas have to come from somewhere. I dont think those many visas are remaining for this year. Be prepared to see FIFO thrown under the bus and approvals with PDs that are all over the place. Please critique this analysis without piling on. Thoughts?
DOS has stated that they have given entire EB1 over flow (approx 25,000 visa's) and EB2 ROW over flow to EB2 I and C. Per my estimate, It is definitely possible that we could see at least 30k to 40k EB2 I approvals for this FY.
If only DOS pulls up some kind of trick and come up with strategy to give similar kind of over flow next year to EB3 I and C. We could see EB3 cut off move to Mid 2003.

The meeting was primarily about undocumented workers and family re-unification. It seemed to be organized by the Latino community and so conducted mainly in Spanish (There was a English translator for others).
There was a decent turnout of IV members but were ultimately overwhelmed by the undocumented crowd.
The congressman talked about immigration as a whole and specifically about the provisions for undocumented workers in his bill. He was asked a couple of questions about legal immigration during Q&A but he did not address them very satisfactorily.
After the meeting, I was concerned that he might not be completely aware of the legal immigration issues. However, I learned that he knows about the issues after talking to IV. Personally, I wish that he had talked a little about legal immigration provisions also in the meeting though.

The line "But those extra numbers would need to be made available to China/India applicants on an equal basis" made me confused. I guess the statement above would still be true if India and China had equal number of pending cases with similar PDs then both countries would have received equal number of unused visas. I missed that fact that visa allocation was by PD. Thanks for the clarification.
Please see the last sentece which says "Thus, the same cut-off date for each country since the extra numbers must be made available in priority date order without regard to country".
When they use this spill over, only PD is imp not the country.

The law 245 (c) clearly states that the status of the applicant may be adjusted to that of permanent resident only if the visa number is available.
Nowhere does it state that the application for adjustment of status can be accepted only if visa number is available.
What part of "an immigrant visa is immediately available to him at the time his application is filed" do you not understand?
And my comments about "The law is the law" and "There is no room for interpretation" refers only to this situation. It is clear as lagoon water that an immigrant visa needs to be available to the applicant at the time that the application is filed. As I said, any attempt to convince USCIS otherwise is a waste of time.

Using your analogy, the more Indians, Chinese, Mexicans, Filipinos stand in the checkout, the lesser the chance for ROW people to get through the checkout. So, how can you say the waiting time will be EQUAL for everyone?
I do not mean equAL waiting time, I mean FIFO. If there are indians/chinese ahead of the line, they are ahead because they got their earlier. So a 2001 Applicant Indian/Chinese is processed before a 2003 ROW. Only Fair.
Numerous different checkout lines(Quotas) are making it unfair so that a 2001 applicant is left to be adjudicated only because s/he is a chinese/phillipino/indian, whereas somebody with 2003 or later PD is adjudicated before.
Thats all I mean.
BTW, I understand that country quotas were designed to probably check growth of any one ethnic group. But I fail to understand how talent and employment based EB;s can be subjected to this, since Talent can come from anywhere.

I was able to attend Tri-State Con Call. These are actionable for us to increase IV membership and awareness..
1. Meet the law members compaign. List of Congress Members is below:

2. Media Campaign: Contact major media outlets and try to publish stories about EB Green card issues.
3. Commercials in Theaters playing Hindi movies
4. Distribute flayers on NJ Transit Buses, Trains and Grocery Stores.
It is up to us to get these initiatives going as soon as we can.

dear friend,
we would all like something to happen. but not everything is in our hands. nor do these things happen easily or quickly. the issues involved are now deeply emotional and political. much of what goes on is in the background and not for public consumption. there is a certain expectancy over immigration reform this year, we cannot afford to waste the sliver of opportunity that may present.
let me put two things to you simply:
1. if you keep waiting for "good news" to make your contribution, and if enough people think like you, well maybe it will never come. you see, the whole thing about iv is that we are trying to make our own destiny. without effort there will be no fruits. many people are making significant efforts, may be you have missed that on your visits to the forum. without the help of many more though, we are sunk.
2. your contribution is intended to create "good news", it is not some reward you hand out after success begins. i realize that you are feeling low and frustrated. please join this effort in earnest- the best way to feel positive is to know you are making your utmost effort. not just money, bring in members and join a state chapter, meet lawmakers and help with campaigns on the forum. If everyone did these things, we would be unstoppable.
please think about it. you have been waiting for months to see results from others hard work. maybe it's time to jump right in.

Congratulations on your GC approval. Do you know how long it generally takes after responding to a RFE to see change in your status?
The RFE response was received on Monday morning . The status changed as review on Monday night and i got approval email today around 12.00
