No point in showing frustration. Its not our birth right. We all were well educated before we came in here. Situation changes. And system makes an adjustment. Dont blame your country( I am also from India), for no one asked us to move out. There are so many nice positions available to work for. More than 80% of us found here a better oppurtunity, because there were no competition at all in getting jobs. 1st come 1st serve.
So do not complain. They do not have any urgency to hand us over the GCs. We can only request them to do the needful on the basis of our sorry state of affairs. Again, we are still at their mecrcy.
So stop complaining. Either wait and support IV or boot out.

No alternate degree requirement or equivalency was mentioned. --> just found out that it did say BS+ 5 exp is ok - USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
- Sponsoring employer revoked approved I-140
- USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
- USCIS denied the pending I-485 based on incorrect I-140 approval
If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

That one phrase in your LC requirement could turn out to be a life saver for you. Can you further clarify the educational/experience requirements mentioned in LC. Was it Masters or equivalent with zero experience OR Bachelors with 5 yrs of progressive experience? Your educational evaluation should meet atleast one of the requirements mentioned in the LC. Either Masters or Bachelors + 5 yrs exp. I think for your educational background (non 4 yr BS degree), I feel more comfortable with getting the evaluation done to satisfy the BS + 5 yrs requirement rather than going for Masters equivalent. NSC is known to be strict w.r.t 3 yr BS degree when it comes to EB-2 cases. However, since your initial evaluation showed you as holding a masters equivalent, I am not sure if its a good idea now to try to defend your case with BS + 5 yrs equivalence. A good attorney would be able to guide you through with this. I also suggest you to consult any reputed attorney regarding this and get feedback on your company attorney's plans and not just blindly follow what your company attorney says.

I work for Fortune 100 company and we are celebrating Diwali on Friday. There are flyers on all the corners and are expecting more than 500 co-workers for pot-luck lunch. Ask them to get an International ATM card with Citibank or ICICI and just withdraw the money here in dollars after they send it to you. It might be around 3% to 5% for transaction charges. I assume you might have gone to Rt 23 DMV, try Rt 46 in Wayne. They are more considerate. I had my DL expiring in April 07 but my H1 was Valid till Sep 07 (the DMV officer had a made a mistake in 04 by putting the wrong experation date when I went to update my DL with Motorcycle endorsement. When I pointed this out he said I still have almost 3 years so come back then:mad:) . I went to Rt 46 Wayne and the lady renewd mine till Dec 07. 90 days more than the valid dates on H1. She said she has already included the grace period which is avaliable in situations of visa renewal so I can renew my visa and get back to them in time. This shows that there is a provision for 90 day grace period.
Try Trenton if Rt 46 in Wayne fails. Best of luck.

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.

I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note. With the May 09 Visa bulletin out, it should now be even more clearer to everyone that there will no progress without coordinated action. This poll shows there are at least 40 people who are interested in doing something to make a difference (thanks to those who have participated so far). Of course, I cannot believe there are not more people out there who want to step forward and make a commitment towards achieving their goal!
At the same time, I am really surprised by the lack of response by Core as well! Maybe there are not enough people in Core to be going around posting in these threads, but isn't that a problem?? I am even more convinced we need to meaningfully expand the Leadership organization and involve more people in order to move forward. It's not realistic to have the same people running around trying to do everything but it doesn't have to be that way.
Core team, would appreciate a response.

I think there are plenty of people who always planned to go back .. the GC /USC was just a career advancement tool for these people. In fact, a survey of US returnees to India after 2000 shows that the majority (around 60%) were USCs/ GC holders, which is clearly an indication that the relocation was by choice rather than any immigration issues.
There are many factors which make the adjustment/re-starting issues bearable : In many cases, the country you will go back to will be a much improved place from the one you left.Besides, many of us immigrated not because we were desperate to get out of our home country; but rather because at that particular point in our careers going abroad was the best way forward. After close to decade's worth of experience in USA, many find that the best way forward now is to go back to your home country .. thats becoming more and more common with globalization. And finally, many of us have family issues like taking care of aged parents which either makes the re-location inevitable or in some cases may coincide with career goals.
Personally, i think returning to one's home country solely because of retrogression is not advisable and has the potential to cause lots of frustration and disappointment.
I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.
Let me restart the discussion. I know we are all frustrated to the extent that we want to pack up and leave but we have invested too much time to do that. But let's assume things start moving and we get our GC's in a year or so. Having spent so many years waiting to "settle" would you be willing to unsettle your life again and start over in a country that you left more than a decade ago.
Note that I am not doubting anyone's intention or disrespecting any entry. Just wondering if its the frustation talking or there are ppl who would actually leave?

AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?
I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.
