    Days when President started talking about fighting to make sure the immigration bill be passed, I felt even people who are here legally should get a fair chance. Not that it is a competetion for immigration, but its playing a fair game.

    The immigration bill if passed, will come and stop at the same place where everyone of us are in now or even worse and pulls the whole system down.

    I'm glad to see such a thing like immigration voice. This will make the law makers think with a broader mind.

    I never understood this "exploitation thing". This is America...

    Exploitation is employer(i.e consulting company) takes 30 - 40% cut from billing from people on H1 but is ready to work on 5-10% commision with people with EAD or GC . (this is no exaggeration talk to EAD/GC guys & you will find many)

    If someone is exploiting we all have a choice. We can change employers; go back home, etc.


    It may not be a totally open market but it is not like you have handcuffs around you. This type of talk of exploiting, slavery only hurts everyones cause.

    Changing employer means start over GC process again unless you have 140. with 140 too many people are not very comfortable switching.

    Thats just too much bull for one day. Just when I thought that it was enough for 2008, you drop this bomb called "God's protection over this land" and made me read those illogical ideas. So this is what I have to say -

    Can you prove the existance of God? Who is God? Where does he/she live?

    You see, down the ages mankind have been told to think in a manner such that - anything that we cannot logically explain, we just come up with the rationale that "God did it". So for the things we can explain, we looks towards that knowledge, but for the things we cannot explain, we still try to explain to ourselves & others by saying - "God did this". And this is how the author is processing information, and this is everyone reading it will understand.

    And this behavior is not a fault of anybody alive. We have inhereted these genes through thousands and millions of years. And those genes in us are designed to make us "blame or credit God" (whichever way you look at it) for everything we cannot explain. Now there will be some who will tell me that I am WRONG for saying "thousdand and millions of years" by arguing that Adam and Eve came just 2000 years back and earth was created in 6 days, and human beings were created some 2000 years old.

    Human mind is extremely inferior. and for own inner sense of inferioirty, we want to tell everybody and our own ego that we know the reason for everything. And for the things we cannot explain, we explain such events to ourselves by using the argument "God is the reason behind those events". We cannot just accept "I don't know how/why it happened". Humans have to explain everything and a lot many times in a day, we explain events by telling ourselves - God did it.

    One more thing, often times, unknowingly, we give more weightage to the writings from people who passed away as compared to the writings by folks who are still around. I think we should question everything told to us, everything feed to our brain - and we have that moral responsibility towards ourselves to question specially the things which are thrown at us with the message - "just accept it without qustioning", because religion and different version of the description of God cannot be questioned. It must be accepted the way it is.

    I think that the greatness of America and its history is not because of the "Religion" or "God", but inspite of it. The fact that "Religion" or "God" is kept out of the Government is the only reason for the progress you see around. For millions of years religion was the center peice of every government, and so our ansestors lived in backwardness. Almost 99% of all inventions have been made in US, where State is "independent" of the "religion", although there are lot of nuts out there who wants to change this. As per the "religious folks" God will never protect a nation that intereferes with the work of religion, right? So why would "God" protect this land?

    Anyways, I want to write for another 200 pages, but, I got to do this job and earn for my family, otherwise "God" will be angry with me.

    .

    How can you judge God's intentions when you don't know Him? Can you prove that God does not exist?

    I myself don't quite understand how exactly education and years of experience are translated into years of SVP. When on my PERM I had MS +5 years of experience required, they said on the denial notice: "The total time time for education, training, and experience entered on Form ETA 9089 equals 5". Which exceeds maximum of 4 years for level 7 (zone IV) and that's why they denied it (again, despite I didn't claim that that the requirements are "normal"). Apparently this 5 is not just experience years, nor just years of education. Does somebody understand how exactly the SVP time is calculated from degree and experience?

    What franklin guesstimated is about right..

    Also there are lots of folks who jumped ahead by switching to EB2 from EB3 and ported their PD's. Those ppl will get GC before U man.

    With out legislative help EB3 (india) will be stuck at 01 of quite a while. I heard on another thread the AILA predicts the oct bulletin would be the same as Jan 07!! Go figure how long you have to wait..

    What the Election Means for Business
    Nancy Pelosi and other Dems may compromise on immigration, but energy, drug, and defense companies can expect hearings

    The Republican Revolution that took Capitol Hill by storm 12 years ago—giving business unprecedented access to the corridors of power—suffered a stunning reversal on Nov. 7, amid an unpopular war, congressional scandals, and widespread unease about the state of the economy, despite generally positive economic numbers.
    After a tumultuous political year filled with bitter personal attacks, Democrats accomplished what pundits said was all but impossible in January: They took back the House of Representatives, and with surprising ease. As of midnight EST, Democrats had taken 33 seats from the GOP—far more than the 15 seats they needed to take control of the House—with another 16 seats still in play. As of midnight, Republicans still were clinging to control of the Senate. Needing six GOP seats to retake the upper chamber, Democrats were leading in five races, with the Virginia race between Republican George Allen and Democrat Jim Webb too close to call.
    Despite President Bush's insistence that the American economy was strong, and getting stronger, 52% of voters said the economy was weak, while just 47% said that the U.S. is in the midst of good economic times, NBC exit polls found. And voters who said the economy was the most important issue to them favored Democrats by 20 percentage points, according to CNN exit polls.

    Democrat Promises
    Candidates and outside groups spent an estimated $2.8 billion to influence the election, the most costly campaign in American history, according to the nonpartisan Center for Responsive Politics. While the massive spending on attack ads and telephone banks helped stimulate local economies from Knoxville to Fresno, it fed into a public anger at the hyper-partisan business-as-usual in Washington, D.C.
    In victory, Democrats promised to change the tone of public discourse. "The message of the public is that it's time for civility and it's time to work toward common goals," said Michael Coleman, the Democratic mayor of Columbus, Ohio. But many voters, recalling George W. Bush's similar pledge in 2000, are likely to wait for concrete action and not just Election Night promises.
    Among the Democratic winners were a host of probusiness moderates, including Representatives-elect Brad Ellsworth of Indiana, a tough-talking sheriff; Heath Shuler of North Carolina, a businessman and former pro football player; Baron Hill of Indiana, a former moderate congressman who made a successful comeback; and Gabrielle Giffords of Arizona, a business executive with strong corporate support.

    Business Benefits
    For business, the election offers hope for bipartisan compromise on some top corporate priorities, although there's also anxiety about aggressive Democratic oversight hearings that could target certain Republican-leaning industries.
    On the plus side, Democratic control of the House means that it is much more likely that Congress will approve comprehensive immigration reform, including a guest-worker program long sought by business interests.
    Democrats also have pledged to rein in the federal deficit and adopt a pay-as-you-go budgeting system, both goals of company reps. And companies are looking forward to Democrats keeping their promise to restore the R&D tax credit, which expired this year amid partisan gridlock on Capitol Hill.

    Possible Changes
    But some business sectors—particularly energy, defense, pharmaceuticals, and insurance—are bracing for tough hearings by new committee chairmen. And small business seems destined to face the first increase in the federal minimum wage in nine years. Democratic leaders have not yet decided whether to push for an immediate increase from $5.15 to $7.25 per hour or to phase it in over two years.
    On the tax front, small business groups now are unlikely to get their top priority: a permanent end to the estate tax. Indeed, a Democratic House Ways & Means Committee seems unlikely to extend any of the Republican tax cuts passed between 2001 and 2003. Instead, Democratic staffers tell BusinessWeek that the party most likely will focus on expanding tax credits for college tuition costs and fixing the Alternative Minimum Tax, which is becoming an ever-increasing burden to upper-middle-class families across the country.
    One industry that Democrats plan to target is oil. House Democratic Leader Nancy Pelosi (D-Calif.) has pledged to roll back the tax incentives given to energy companies in the Bush-Cheney energy package. Democrats want to spend that money instead on alternative energy sources and green technology.
    Still, Democrats can only do so much in an era of divided government. President Bush, with his veto power, can stop any legislation he views as too liberal. And Democrats can't afford to alienate the independent voters and suburban moderates who gave them control of the House.

    I dont think we need to waste our time about such non competent organizations , let them take the credit , it just shows that this was a great idea. Looking at their website it does look like they have some good contacts .

    I think immigration voice should write them a formal letter and ask them to publicise this to their "contacts" ..

    If they got themselves into this picture well,lets put them to work!

    My advice to most people who do not perfectly fit into eb2 is to do the eb3 petition first (which is guaranteed to be approved). Get your place in line for the greencard.

    Good suggestion.

    If it is taking too long then you can try an eb2 later; if it gets approved then you will get the old priority date. If it doesn't; well you can say you tried but you didn't lost your place in line for the greencard because you still have the old eb3 in place.

    As if the porting rules are going to stay the same. There are many things legit eb2 people are doing that will make this bogus porting impossible.

    However, if your cases is not clear for eb2 and you try this first and it gets denied then you will lose valuable time in line for the greencard because you have to start from the beginning.



    Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).

    These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.

    However, this isn't the same criteria DOL uses. They will state that if a person doesn't have a degree then you are willing to accept 12 years of experience which is excessive and they deny the labor (before they were giving hard time to eb2 but not it is eb3 that they are after). So now we have an issue that DOL criteria is different then uscis critera. You use dol criteria, labor gets approved but 140 gets denied. Use uscis criteria and labor gets denied.



    Now, everyone has to adjust and file eb3 labors as skilled workers and only require two years of experience (it's getting more and more messy)

    I did not know unskilled workers can file for greencards in EB3. I think things are getting better and USCIS is now trying to stick to the rules.

    The USCIS is required by regulations to issue a temporary EAD if they cannot process extension in 90 days. They, however, do not issue temporary EAD anymore in violation of the regulations. So if more than 90 days passed and you are still waiting, take an infopass and request IO to call service center where EAD is pending and request to follow procedures outlined in the USCIS memo

    (print the memo and take with you). Do not leave until they do that, request to talk to supervisor if IO refuses.

    Upon receipt of Form I-765 requesting an interim EAD, local field offices are required to perform the following tasks:

    o Determine if RFE has been issued, thus tolling the 90-day adjudicative requirement
    o Form I-765 remains unadjudicated
    o Biometrics have been captured—if not, refer to ASC
    • Contact NBC or Service Center to initiate EAD production—either Interim or Non-Interim
    • Provide Notice to applicant acknowledging status inquiry.

    Even if EAD expired, you can continue working up to 180 days and be covered by INA 245(k) (i.e. your GC is not affected). Employer may be sanctioned, however. Employer may ask you to take an unpaid leave also.

    My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

    Does anyone know what the legislation is?

    First your PD has to be current for USCIS to look into your RD.

    There is nothing to discuss on this. Just take the cash to any national bank SBI or ICICI or UTI and ask them i want to wire trasfer to US bank account. They ask you to fill up wire trasnfer form by giving US bank accout and routing numbers. They just do it by taking some fee for wire transfer. Thats it. You will get into your US bank account in a day. Thats for sure. I did this number of times. I don't know, you guys make it complex everything, by saying NRE/NRO/RBI etc. It just damn simple, do wire transfer.

    Rupee is not yet fully convertible! So if its a big amount (dont remember the upper limit) you cannot wire... The only way you can do get it is for education or medical reasons. Lookig at the way the dollar is tanking I wouldnt be surprised if the rupee becomes fully convertible sooner that initially planned!

    Do they ask me regarding this at the POE? In what forms do I have to fill the info? I am not sure, as one of you suggested, if they ask we will tell them. But does this record appear in their computer screen and if we did not mention to them, will it be treated as another crime?

    God please help me , It's THE WORST thing ever I did and been trhu a painful experience
