    Looks like a few people at USCIS know that some kind of masters degree from india with a 3 years bachelors unrelated to ones profession cannot be used in place of US masters. Did not realize that USCIS has some people who know the rules and play by them. If all USCIS people who approve these cases know about this and if lawyers stop justifying that correspondence masters degree is equivalent of US masters, bogus initial eb2 applications as well as porting could be stopped.

    Looks like policiticans are doing some work here.

    USCIS knows the rules better than you and they DO apply the rules correctly. If you know of a case where there is a violation you are free to complaint to CIS rather than ranting in a public forum.

    A correspondence Masters from an ACCREDITED university is legit. As I said earlier, if a degree from a Accredited University is invalid than your degree is also invalid. There are tonns of legit US universities offering Online courses --- some examples are University of South Dakota, University of Massachusetts, Northeastern University etc.

    I challenge you --- say in a public forum that degree earned through online courses from these universities are bogus . I will make sure to forward that link to these universities and you can spend more time defending a defamation law suit than anything else.

    Days when President started talking about fighting to make sure the immigration bill be passed, I felt even people who are here legally should get a fair chance. Not that it is a competetion for immigration, but its playing a fair game.

    The immigration bill if passed, will come and stop at the same place where everyone of us are in now or even worse and pulls the whole system down.

    I'm glad to see such a thing like immigration voice. This will make the law makers think with a broader mind.

    Bottom line: The current house immigration caucus boasts 104 members. Of which, 4 will be gone come January 2007. From the remaining, IF all the tossups were to go democratic, the list would come down to 90 members.

    I will update the thread with the final results Nov. 7th.

    Nov. 7th update: As seen above, from the original 104, the list is now down to 95 members. With the House majority in the Democratic hands, this loss in the caucus is likely to be magnified since they are now the minority in the minority.

    I visited the PA DMV yesterday to renew my driving licence based on my pending I-485. With all the valid documents like EAD, I-485, SSN card, I-94 etc. They refused to renew it saying that they have a new pilot program implemented called SAVE and need to get clearence from that, it will take upto 30 days. Anybody else gone throgh this proces?? Day by day more hurdles to pass...what a life, why dont they keep their systems uptodate or provide some temp permit as long as their check is pending. I am frustated with all this GC process, name check, DL SAVE system check etc..Why dont they implement just one check and give approval to everything.. atleast make it less time consuming.

    Anythoght from anybody? anybody else went through this SAVE (Systematic Allien Verification for Entitlement) program, or am I the only one??

    Yes, 4 of my frineds in Colorado went through the same process called the "SAVED". I was the one who started this thread to find out if other states have already started using SAVE and it seems other states are reluctant to use it.

    Ironically, the DMV in Colorado got sued last week regarding this new process because US citizens were badly affected by this. Please read the article below.

    My wife's DL will expire on 02/07 but because of this new process, we decided to visit our local DMV here.

    They renewed her license with just the new 797 and passport as the requirement. I don't know if the law suit has got something to do with the change.

    My other friends are still waiting to be cleared by SAVE and couldn't drive.

    What the Election Means for Business
    Nancy Pelosi and other Dems may compromise on immigration, but energy, drug, and defense companies can expect hearings

    The Republican Revolution that took Capitol Hill by storm 12 years ago—giving business unprecedented access to the corridors of power—suffered a stunning reversal on Nov. 7, amid an unpopular war, congressional scandals, and widespread unease about the state of the economy, despite generally positive economic numbers.
    After a tumultuous political year filled with bitter personal attacks, Democrats accomplished what pundits said was all but impossible in January: They took back the House of Representatives, and with surprising ease. As of midnight EST, Democrats had taken 33 seats from the GOP—far more than the 15 seats they needed to take control of the House—with another 16 seats still in play. As of midnight, Republicans still were clinging to control of the Senate. Needing six GOP seats to retake the upper chamber, Democrats were leading in five races, with the Virginia race between Republican George Allen and Democrat Jim Webb too close to call.
    Despite President Bush's insistence that the American economy was strong, and getting stronger, 52% of voters said the economy was weak, while just 47% said that the U.S. is in the midst of good economic times, NBC exit polls found. And voters who said the economy was the most important issue to them favored Democrats by 20 percentage points, according to CNN exit polls.

    Democrat Promises
    Candidates and outside groups spent an estimated $2.8 billion to influence the election, the most costly campaign in American history, according to the nonpartisan Center for Responsive Politics. While the massive spending on attack ads and telephone banks helped stimulate local economies from Knoxville to Fresno, it fed into a public anger at the hyper-partisan business-as-usual in Washington, D.C.
    In victory, Democrats promised to change the tone of public discourse. "The message of the public is that it's time for civility and it's time to work toward common goals," said Michael Coleman, the Democratic mayor of Columbus, Ohio. But many voters, recalling George W. Bush's similar pledge in 2000, are likely to wait for concrete action and not just Election Night promises.
    Among the Democratic winners were a host of probusiness moderates, including Representatives-elect Brad Ellsworth of Indiana, a tough-talking sheriff; Heath Shuler of North Carolina, a businessman and former pro football player; Baron Hill of Indiana, a former moderate congressman who made a successful comeback; and Gabrielle Giffords of Arizona, a business executive with strong corporate support.

    Business Benefits
    For business, the election offers hope for bipartisan compromise on some top corporate priorities, although there's also anxiety about aggressive Democratic oversight hearings that could target certain Republican-leaning industries.
    On the plus side, Democratic control of the House means that it is much more likely that Congress will approve comprehensive immigration reform, including a guest-worker program long sought by business interests.
    Democrats also have pledged to rein in the federal deficit and adopt a pay-as-you-go budgeting system, both goals of company reps. And companies are looking forward to Democrats keeping their promise to restore the R&D tax credit, which expired this year amid partisan gridlock on Capitol Hill.

    Possible Changes
    But some business sectors—particularly energy, defense, pharmaceuticals, and insurance—are bracing for tough hearings by new committee chairmen. And small business seems destined to face the first increase in the federal minimum wage in nine years. Democratic leaders have not yet decided whether to push for an immediate increase from $5.15 to $7.25 per hour or to phase it in over two years.
    On the tax front, small business groups now are unlikely to get their top priority: a permanent end to the estate tax. Indeed, a Democratic House Ways & Means Committee seems unlikely to extend any of the Republican tax cuts passed between 2001 and 2003. Instead, Democratic staffers tell BusinessWeek that the party most likely will focus on expanding tax credits for college tuition costs and fixing the Alternative Minimum Tax, which is becoming an ever-increasing burden to upper-middle-class families across the country.
    One industry that Democrats plan to target is oil. House Democratic Leader Nancy Pelosi (D-Calif.) has pledged to roll back the tax incentives given to energy companies in the Bush-Cheney energy package. Democrats want to spend that money instead on alternative energy sources and green technology.
    Still, Democrats can only do so much in an era of divided government. President Bush, with his veto power, can stop any legislation he views as too liberal. And Democrats can't afford to alienate the independent voters and suburban moderates who gave them control of the House.

    I think it is still June 29 2007

    so TSC processing time actually retrogressed this month by 8 days if it is at June 21. For times of April, it shows that they are processing June 29, 2008.

    what is going on man. when will they get to Aug 7. but then again, if EB3 is not avaialable then what si the point.

    Very unexpectedly, just last year in a hospital, the doctor told me that unless I get operated ASAP, there is not much chance for me to live. As I was still trying to digest that news, I was thinking...

    ***k the Green card. ***k my job. I just want to live few more years until my son grows to at least 18 (he was just 1-and-a-half at that time).

    And I really laugh about the whole incident now. And when I see others vent or getting upset about something, I can't help but get a smile. Because I learnt the hard way that we never appreciate what we have got and always complains about what we haven't got.

    It's New Year time!! Enjoy and cherish your presence. And forget about the job/visa for a day or two.

    Please ...let us agree on this ...will get an EAD even if i-140 is pending while 485 is filed correct??

    This is not a democracy or an American Idol show where it matters what most people think!

    There is a law that clearly states it - you can file and are eligible to interim AOS benefits such as AP & EAD even when the I-140 is pending. I have colleagues (who applied 140 & 485 concurrently) get their EADs and APs long before they got AOS approva.

    It's a different thing, not not to be confused with, that most people choose to continue with their H1 and not use EAD or AP because of the uncertainty until the 140 and 485 is approved.

    USCIS will go according to the ND. They will not follow PD. PD is used only to make the application eligible for adjudication or to apply for AOS. One filed, it is the application ND that takes priority. For example, if there are two EB2 applications, and the PD for the two are Aug 2002 and Aug 2004, and the ND for these two are June 2006 and Jan 2006 respectively, the applicaiton with ND of Jan 2006 gets priority, provided both PD are current.

    Looks like it is for illegal immigrants as it asks for continous stay. Most legals would not have stayed continously as they might went out of country for vacation

    I wonder how it would work for existing AOS applicants. The existing applicants have already applied under the INA c9 subsections. The text of the current bill states that the applicant needs to apply under this bill's section to adjust status, similar to 245i. Now if this means reapplying under this section, that would mean another flood of applicants. Obviously with such a deluge, you wouldnt need a quota, the CIS system itself will take years to sort out the applicants.
