Any way, I think you don't need IV's (for that matter any organization's support) to file a law suit. If you think USCIS is breaking the law, you can file a law suit with the help of a lawyer. A couple of $100 is all that would cost you.

It was lawsuit filed by AILA, efforts by IV and other groups that reversed the decision. Gandhigiri in this country has very little value. This country works on laws/court system. We need to get laws to help us and we need support groups like IV to make that happen. Or else we can pray to God to shower some green.

1) Asking people not to walk out of homes and pay up their loans
2) Making the wall street firms like Lehmen, bear sterns run their businesses as usual.
3) Contain the inflation so that long term interest rates are lowered.
4) Come out clean if the US policy is shifting towards Weak dollar or going back to string dollar policy. Either way US and world over have to face gyrations in near term.
There is blood on everybody's hands for the mess we are in.
1) Japan for too long provided the world with cheap loans (~1%).
This money not only found its way to corprate India but also into US
Housing markets.
2) Americans spent money much much more they earn or worthy off.
3) Globalization created another affect (Read Alan greenspan's 'economic conundrum' theory). Google it, you will find plenty of articles.
4) China for too long manipulated their currency and provided the world cheap goods.
5) Oil exporting countries didn't utilize the profits in developing their countries and economies. Instead they started buying aasets all over the world causing unsustainable price levels in asets.
6) Indian software industry far too long booked profits without developing/diversifying into enterprise strength products and remained fixated on their business models. Software sector is staring clueless and is unprepared for the fallout of outsourcing industry. Pink Slip culture is on the rise.
How do we come out of this financial mess in US?

Lets learn from the chinese! dont you think they smell of fish and frogs, they cant speak proper english, they do not dress properly etc etc but they get their job done and are slow and steady. Part of the reason they are not easily insulted as we are is, they are very very humble people. They have learnt to respect others. Now look at we Indians. I am from South India. Do you think if I travel to the North I will be respected, let alone be considered a normal human being?? We tend to view everything that way. Go to any university and you will see a mumbai group, a chenai group, bihar group etc etc. First let us speak of how WE INDIANS treat other Indians. This is just like the Middle east right? When they have a common enemy they stand as one, otherwise they always fight among themselves. As somebody previously pointed out.
1) Respect yourself and others (americans). They are not used to your spicy smell, oil smell, untidiness etc. Instead of blaming them for not cooking, it would be better for us to take a few precautions: hand your dress/coats etc in a separate room with door and keep it always locked, preferably put a perfume paper or something on the floor in that room.
2) Learn to use chewing gum before group meetings.
3) Work to develop a cheerful attitude. Dont expect to be treated as a child is treated by a parent (always cared for type of thing). Smile and be happy.
4) Please dress decently and tell your friends to do so also. Many people dont know this basic requirement in the US.
5) Finally learn to smile at a fellow Indian, no matter which part of the country he/she is from.

And remember this will happen to any person whether its an Alien / American. As an alien we will naturally be attacked more if we are not GOOD enough. Isn't it assumed that H1B is to bring in the best of the rest of the world into this country?? So lets try to be that best and do our best.

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc,west virginia north and south carolina. Arranging busses for the students is not a bad idea. Lately i see a lot of new members coming up in the forum, with lots of questions about their problems that they are facing. And lots of good hearted IV members also give their diligent answers for them. One hand I am glad IV is getting new members, on the other hand i am wondering where were these members all these days.
Please don't get me wrong, As much as I like new members joining in the forum to get answers for their questions, I also would expect them to take part in any the activities or initiatives that IV is undertaking. Therefore I urge, every new member to volunteer in the IV activities and be an active member of IV and be a participating member, so that IV helps you and you help IV. If point sysem is introduced the big losers are immigration lawyers as they cannot make money in multiple stages. So no wonder if they oppose. Of course there is some limitations but its sucess depends on rules and regulations. Also there is going to be a Cap and there is going to be a provision to prevent displacement of US workers as the worldwide demand is always here. But main advantage is it will bring down the work load of various agencies like DOL and INS also employers.
the reason it will never work is not the lawyers. the immig lawyers for the most part are honest people.
the problem is the employers. employee's loss is employer's gain. it is simple enough. if the point based immigrant is allowed in with a EAD or a green card (like in canada/australia), the employers lose out big time.
The only reason h1 exists is because employers want cheap labour. That is why they want more h1s. Because h1s are justified from business point of view, that is why it is illegal to charge the employee for the h1 costs.
But they never talk about how the h1s get screwed.
Because the h1s are screwed by them.

Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.
We received our 2nd biometric appointment notice for Sep 11th. Our Notice date is Sep 19th 2007. Just keeping my fingers crossed and hoping for something good. :)

My kids didn' go to day care until they are 1.5 years old, then they want to babysitter , they started going to day care after 2.5 years. Day care is right place for kids after 2 years, because they need other kids to play, staying home is boring for them. I have personally experienced this.

This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.
These are my observations. I could be grossly mistaken. Pardon me if I am wrong.
There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.
Here I have ignored EB3 India 2001 guys. But that number would be very less I believe.
1% of 400k is 4000 which is what USCIS issues GC for EB3 India in a year.
Does that mean I could get my GC this year.
Hope these numbers are right.
We are going to clean up data further in the coming weeks. People who have missing fields may not be part of the tracker etc. The analysis will also be expanded to give more representation of the data from all angles. We are also working on some more features in the tracker that will make it really informative. At this time we are waiting for everyone to input their data or update their data and also get others who do not have a profile on IV to come here and input their data. Please help us in this task and bring everyone to IV tracker. Once we have more data that can help us represent a better % of the overall actual applications in USCIS data, the analysis will be much better. At a later stage we are thinking of bringing some statistics experts on board to create monthly analysis of the data and publish report for our members.

I'm also going to do a FOIA request for my I-140 that got approved in Jan 08. Employer is saying its their petition and they wont share it. I'm not going into argument because they revoke it now - The Legal Immigration system is too weak and too much lopsided to a "employer" rather than on the "individual employee"
I know during a PD porting to another AC21 employer this approval notice is sufficient even if the I-140 is revoked but my doubt is if my I-140 gets revoked can i switch to another employer and extend my H1B by 3 more years ??
