Immigrationvoice would like to reach out to its community to find out if they are facing any problem with AC21 related issues or had faced any such issue in the past. If you had received a denial of your application for example not having the same designation/ different salary/different location etc... please contact and we would like to assist. This would also help us try solve the larger issue of restrictions on applicants during their greencard journey where they are bound with employers, salary, designation, narrow occupation field etc.

EB1 or EB2 or EB3 is created by USCIS. We are just applicants. We were not asked to give our 2 cents to frame the rules.
So there is absolutely no logic for us to fight among self. Target is USCIS. EB2 can raise their concerns, EB3 can raise their concerns or both can do it together. Lets get that straight.

In your article the writer makes a link between high-skilled workers and illegal aliens by talking about the two groups in the same paragraph, thus conveying to the average reader that the two are connected, and/or that high-skilled workers are illegal yet �must be retained�
This is misleading in extreme. High-skilled workers are in the U.S. on Legal visas that are sponsored by their employers. These visas are issued to limited numbers of foreigners in areas where no American workers have been found. These legal workers have to go through grueling government �labor certifications� and extreme waits and red tape just to perform their work, which usually includes U.S. patents and successful start-ups. I urge you to make a correction or an errata to this article which is probably an honest mistake, but which is very unfair, misleading and just plain untrue. Thank you once more.

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...
My history - Made $0 contributions so far..and have been wanting to contribute for a long time now..but keep backing away..

I see one problem in allowing contribution with lesser denomination provision though; majority would sign up for the lesser amounts. I am not talking about casual onlookers. I am talking about serious potential contributors who are convinced of IV cause and ready to contribute. They could easily go for $50, but rather, a lesser contribution option would tempt them down! In essence, it would seem like the bar was set down.
All in all, we have to remember. IV is not supported by any 'no-nonimmigrant-left-behind' federal program.
If you cannot do recurring contributions, you can do it in one time payments.

5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.
All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.

No. This was the recommended workaround by a parents group that intended to file a PIL at one point. I will be able to try this next year though. I will send out the letter above too.

:confused:I am in same situtation. I want to reenter on AP and continue on H1-B. Can I do that? My company says its their policy that once I use AP to enter I will have to switch from H1-B to EAD. I dont want to do that. Can I still continue on H1-B?

Guys if you compare the way people live and spend in India, I think they are more well off then we are. I know some friends here, all they do is, look for coupons. They’ll fight all day with Customer care reps for $1 extra that company charged, they don’t leave tips when they eat out and they eat out once in 6 months. Except for a Camry and a leather chair may be a better bed, what is this guy doing better than he would have done in India. Atleast there he had a ‘Kamwaali’ who did the cleaning for his family. He had a tutor who taught his daughter. Here in US all he’s doing is cleaning bathrooms, kitchen their his children ad driving his Camry.
Not only they are saving $1 by fighting with customer service rep to dispute the $1 admin fee on the phone bill or some other fake charge on credit card bill, they are also saving a lot of money by not contributing to Immigration Voice.
So combine all this:
1. Being cheap patrons at restaurant, not giving tips (buffet restaurants dont deserve tips according to the cheap indians).
2. Bringing stinky dinner for next day's lunch therby saving lunch money and not eating out with co-workers. Even more savings from potential situations where you have to tip.
3. Wearing sneakers instead of leather shoes on weekdays. Sneakers are cheaper than leather shoes and sometimes even look good with trousers and dress shirts.(yeah right...)
4. AND MOST IMPORTANTLY...BEING SMART ABOUT IMMIGRATION VOICE AND NOT CONTRIBUTING $20 per MONTH.
See, all this adds up to a fortune when you multiply dollars times 40 (or 43 or 38 whatever the heck the exchange rate is)..........................

He said the presence of about 11 million illegal immigrants makes a mockery of all those who are going through the process of immigrating legally.
"Indeed, after years of patchwork fixes and ill-conceived revisions, the legal immigration system is as broken as the borders. Backlogs and bureaucracy means the process can take years," he observed.
He was quick to add that immigration reform has been held hostage to political posturing and special interest wrangling and to the pervasive sentiment in Washington that tackling such a thorny and emotional issue is inherently bad politics.
The president said besides addressing the issue of illegal immigrants, a reformed system also needs to address the need for talented people to stay and contribute to the country.

This is not good. My PERM labor is stuck in Atlanta, I was hoping to apply I-140 pp since my 6th year H1 is expiring Dec, 07. If I can get my I-140 approved then I'll have to leave.
1. If your labor was filed in Nov 06 or earlier then you can file for 7th year extension (based on rule that labor pending for more than 365 days)
2. I'm not 100% sure but i think when your labor is approved if PDs are current, you can file i-140, 485, EAD together and get EAD by before your visa expires and you would be fine.
3. Labor substitution will not be allowed after July 17th, and there are a lot approved labors whose beneficiaries have left the company. Employers are willing to use these labors for whatever they get (excuse me!). If you really want to stay in US, find an approved labor with PD older than Nov 06 and then file I140/485/EAD, if you don't get EAD by Dec 07 then file 7th year ext based on the GC pending more than 365 days. Hurry up for labor..

Renewal of License or a New one for H1 or H4 or related visa... is fully based on I797... this rule has been applied since last 3years.. who all arrived in PA before 2002 or so... are safe they get the license renewed for more than 5 years but who are after that gets only renewed as per the I797 expiry date.. the problem lies what our I797 gets delayed, we cant drive ... sit home ... does anyone have a work around or dealt with such situation

I'm not sure about the usefulness of this poll? If you look at the percentage of people applied on 2nd July, it is close to 70%. Assuming some error in the polling percentage, this poll indicates that atleast 50% of people have appplied already on 2nd July. As per the press reports, USCIS has received around 55000 applications on 18th July. That means another 55000 people only are going to apply by 17th Aug making a total of 110,000 plus minus 20,000. I do not believe this number and the poll. Any arguments here?
